It is declared to be of importance to the health, safety and welfare of the inhabitants of the town that the following Electrical Inspection Ordinance be adopted.

A. 
All inspectors, as defined in this chapter, are hereby authorized and deputized as agents of the Town of Bedford to make inspections and reinspections of all electrical installations as heretofore and hereafter described, and to approve or disapprove the same. In no event, however, will the cost or expense of such inspections or reinspections be charged against the Town of Bedford.
B. 
Inspectors defined. Any electrical inspector possessing a valid and subsisting certificate from the International Association of Electrical Inspectors to perform inspections of one- and two-family dwellings and commercial establishments who is registered with the Town of Bedford in accordance with the provisions of this chapter.

A. 
Any person desiring to be an inspector must register with the Building Department of the Town of Bedford to perform electrical inspections by providing the following information and documentation to the Town Building Inspector or his designee for review and determination as to its acceptability:
(1) 
A copy of a valid and subsisting certificate from the International Association of Electrical Inspectors to perform inspections of one- and two-family homes and commercial establishments. The original certificate must be displayed to the Town Building Inspector.
(2) 
Such person's address and telephone contact number and e-mail address if available.
(3) 
Proof of insurance showing worker’s compensation, general liability, and other coverage naming the Town of Bedford as an insured and an agreement to defend and indemnify the Town of Bedford in each case in such scope and amount as the Town Board shall set by resolution.
(4) 
If such person is a firm, corporation or other entity, the subject certificate must be provided for each employee for whom authorization is sought to perform electrical inspections.
(5) 
A fee schedule for charges to be incurred by a property owner for an inspection.
(6) 
Any other documentation deemed necessary by the Building Inspector.
B. 
The authority granted to an inspector under this chapter shall expire on December 31 of every year, but shall be subject to reauthorization within 30 days prior to such expiration upon confirmation or resubmission of the certification and information required under § 52-4A.
C. 
The authority granted to any inspector in accordance with this chapter is subject to revocation upon the Town Building Inspector's receipt of evidence that the subject inspector has violated this chapter. Any disputes as to the basis of revocation of such authority shall be referred to the Town Board, whose determination shall be binding.

A. 
It shall be the duty of the Inspector to report in writing to the Chief Building Inspector, whose duty it shall be to enforce all provisions of this chapter, all violations or deviations from or omissions of the electrical provisions of the Building Code applicable to the Town of Bedford and all local laws, ordinances and the Building Code referred to in this chapter, insofar as any of the same apply to electrical wiring. The Inspector shall make inspections and reinspections of electrical installations in and on properties in the Town of Bedford upon the written request of an authorized official of the Town of Bedford or as herein provided. The Inspector is authorized to make inspections and reinspections of electrical wiring installations, devices, appliances and equipment in or on properties within the Town of Bedford where he deems it necessary for the protection of life and property. In the event of an emergency, it is the duty of the Inspector to make electrical inspections upon the oral request of an official or officer of the Town of Bedford.
B. 
It shall be the duty of the Inspector to furnish written reports to the proper officials of the Town of Bedford and owners and/or lessees of property where defective electrical installations and equipment are found upon inspection. He shall authorize the issuance of a certificate of compliance when electrical installations and equipment are in conformity with this chapter. He shall direct that a copy of the certificate of compliance be sent to the Town of Bedford, to the attention of the Building Inspector.
A. 
It shall be a violation of this chapter for any person, firm or corporation to install or cause to be installed or alter electrical wiring for light, heat or power in or on properties within the Town of Bedford until an application for inspection has been filed with the New York Board of Fire Underwriters.
B. 
It shall be a violation of this chapter for a person, firm or corporation to connect or cause to be connected electrical wiring in or on properties within the Town of Bedford for light, heat or power to any sources of electrical energy supply prior to the issuance of a temporary certificate or certificate of compliance by the New York Board of Fire Underwriters.

An offense against the provisions of this chapter shall constitute a violation under the Penal Law and shall be punishable by a fine of not more than $250 or by imprisonment for not more than 15 days, or both.

This chapter and the penalties provided herein shall be in addition to, and not in substitution of, the rights and remedies of the Town of Bedford and its inhabitants, at law and in equity under the Penal Law, the Public Health Law or the Town of Bedford Zoning Ordinance of 1983, as amended, or any and all laws or ordinances relating to the conduct or activities similar to those defined herein.
