The following words shall have the following
meanings in this chapter:
ASHES
Residue from fires used for cooking and for heating buildings
or from the burning of any combustible material, no matter how described.
GARBAGE
Wastes resulting from the handling, preparation, cooking
and consumption of food; waste from the handling, storage and sale
of produce.
LITTER
Includes any uncontainerized man-made or man-used waste which,
if deposited within the town otherwise than in a litter receptacle,
tends to create a danger to public health, safety and welfare or to
impair the environment of the people of the town. "Litter" may include,
but is not limited to, any garbage, trash, refuse, confetti, debris,
grass clippings or other lawn or garden waste, newspaper, magazine,
glass, metal, plastic or paper container or other construction material,
motor vehicle part, furniture, oil, carcass of a dead animal or nauseous
or offensive matter of any kind, or any object likely to injure any
person or create a traffic hazard.
REFUSE
Combustible trash, including by way of illustration but not
limited to, paper, cartons, boxes, barrels, wood, excelsior, tree
branches, yard trimmings, wood furniture and bedding; noncombustible
trash, including by way of illustration but not limited to metals,
tin cans, metal furniture, dirt, quantities of rock and pieces of
concrete, glass, crockery and other mineral wastes; street rubbish,
including by way of illustration but not limited to street sweepings,
dirt, leaves, catch basin dirt, and contents of litter receptacles;
wastes from building operations, food-processing wastes, lumber, scraps
and shavings.
It shall be unlawful to cause or permit to accumulate
any garbage, refuse, litter or ashes that can be blown away by the
wind anywhere within the Township of Saddle Brook.
It shall be unlawful to throw, deposit or permit
to fall any garbage, refuse, litter or ashes on any public street
or alley in the Township of Saddle Brook.
It shall be unlawful to dump or place any garbage,
refuse, litter or ashes on any premises, public or private, in the
Township of Saddle Brook without the express written consent of the
owner of said premises.

A. Any person, firm, partnership or corporation violating
any provision of this chapter shall be subject to a fine for a first
offense of not less than $100 and not more than $1,000, plus costs
of removal, for each offense or imprisonment in the county jail for
not more than 30 days, within the discretion of the Judge presiding
in the Municipal Court of the Township, or both. A separate offense
shall be deemed committed for each dumping violation which occurs
for which a separate penalty may be imposed.
B. Any person, firm, partnership or corporation violating
any provision of this chapter for a second offense shall be subject
to a fine of not less than $500, plus costs of removal, for each offense
or imprisonment in the county jail for not more than 30 days, within
the discretion of the Judge presiding in the Municipal Court of the Township,
or both. A separate offense shall be deemed committed for each dumping
violation which occurs for which a separate penalty may be imposed.
C. The Building Inspector and/or a member of the Police
Department shall be responsible for enforcing this chapter.
