WHEREAS, the Town of West New York has passed certain ordinances which are amenable to the issuance of a summons and violation notice at the moment of its observation and detection and the payment of a fine without the necessity of a court appearance should the defendant plead guilty, and
WHEREAS, the quick and proper enforcement of these ordinances is in the best interest of the health, safety and welfare of the citizens of the Town of West New York:
Any violation of the following enumerated ordinances may be settled out of court, unless a court appearance is specifically required, if the defendant pleads guilty by the signing of his name on the back of the summons and remitting the proper fine to the Clerk of the Municipal Court.
A. 
In enforcing this article, the Judge of the Municipal Court shall utilize the form of the summons with complaint or a notice in lieu of complaint, as approved by the Administrative Director of the Courts. The summons or notice may be served by law enforcement officers of the Town of West New York upon any persons, corporations, business firms or partnerships violating any section or sections of this article.

B. 
The Judge is further authorized by rule to provide that violators may sign and execute on the back of the summons a written plea of guilty, appearance waiver and waiver of right to a hearing and agreement to pay the penalty prescribed for the violation. The fine for any offense of these sections shall not be more than $1,000.

The provisions of this article shall include and be limited in their effect to the following ordinances:
Ordinance No. 890--An ordinance regulating the manner in which refuse shall be stored, collected and disposed of. (See Ch. 203, Art. II.)
Ordinance No. 906--An ordinance prohibiting the throwing or depositing of litter, abandonment of shopping carts, controlling the depositing of litter on public streets, on roadways and on private premises and prescribing penalties for the violations thereof. (See Ch. 139.)
Ordinance No. 970--Nuisance Code. (See Ch. 152.)
Ordinance No. 914--An ordinance prohibiting the use of the sidewalks and public streets for the purpose of dismantling, repairing and painting motor vehicles and other vehicles. (See Ch. 206, Art. IV.)
Ordinance No. 1101--An ordinance to prohibit graffiti or the defacement of public or private property. (See Ch. 97.)
Ordinance No. 1167--An ordinance providing for the licensing of dogs and ordinances included, thereto. (See Ch. 99.)
Ordinance No. 1127--An ordinance requiring commercial, business and multifamily property owners and managers to take care of their property and to keep same in good repair, etc. (See Ch. 174.)

The following officers of the Town of West New York shall have the authority to issue the form of summons with complaint set forth in §§ 1-18 and 1-19 of this article:
A. 
Sanitary Inspectors.
B. 
Health Investigators.
C. 
Safe and Clean Inspectors.
D. 
Housing Inspectors.
E. 
Police officers.
F. 
Code Enforcement Officer.
