There is hereby created within the Town of Clay
a separate department of town government to be known as the "Department
of Recreation and Human Resources."
The Town Board of the Town of Clay enacts this
article to create a new department to be known as the "Department
of Recreation and Human Resources," to provide the appointment of
a Commissioner of Recreation and Human Resources and to define his
duties. The Department is created for the purpose of coordinating
and consolidating the recreational and educational programs, youth
programs, elderly programs and narcotics guidance activities of the
Town of Clay.
There is hereby created the office of Commissioner
of Recreation and Human Resources to administer the Department of
Recreation and Human Resources. The term of said office shall be for
a term of two years and until a successor, or successors, shall have
qualified; provided, however, that the appointee to such office shall
be removable at the pleasure of the Town Board. The office of Commissioner
of Recreation and Human Resources shall be a full-time position. The
appointee to said position shall serve in the unclassified civil service.
The qualifications for the office of Commissioner
of Recreation and Human Resources shall be a minimum of a bachelor's
degree in recreation administration or a related discipline together
with three years' experience in recreation administration or related
occupations, or a bachelor's degree in an unrelated discipline together
with five years' experience in recreation administration or related
occupations.
The Commissioner of Recreation and Human Resources
shall be responsible to the Supervisor as the chief executive officer
of the town pursuant to the Suburban Town Law, and shall have the
following responsibilities and duties:
A. Exercise those powers and duties necessary for the
general supervision of the Department of Recreation and Human Resources.
B. Plan, organize, direct and review administrative procedures
necessary to the operation of the Department of Recreation and Human
Resources.
C. Supervise and review the work of departmental subordinates
and report periodically to the Supervisor concerning the operation,
financial condition and future financing needs of his Department,
and shall have the power to employ such officers and/or employees
as he deems necessary for the proper operation of the Department of
Recreation and Human Resources, within budgetary limitations established
by the Town Board of the Town of Clay.
D. Be responsible for planning, promoting, organizing
and administering a comprehensive recreational and cultural program
for residents of the Town of Clay of all ages.
E. Be responsible for the development of a plan for the
acquisition and development of existing and future parks, playgrounds,
recreational areas and facilities; be responsible for supervising
the development and operation of such parks, playgrounds and recreational
areas and facilities as may be now owned or hereafter acquired by
the town.
F. Advise the Town Supervisor and the Town Board with
respect to matters within the jurisdiction of the Department as may
be requested. The Commissioner shall provide such cooperation and
assistance to other departments of town government as may be requested
and appropriate.
G. Prepare an annual budget for approval of the Town
Board and shall authorize and approve all expenditures from funds
appropriated for the Department. The Commissioner may establish fees
and charges for use of facilities and participation in activities
under the supervision of the Department subject to the approval of
the Town Board. All fees or charges collected by the Department shall
be turned over to the Town Supervisor and become part of the general
fund of the town.
H. Such other duties as may be assigned by the Supervisor,
the Town Board or other provisions of this Municipal Code.

The following advisory committee is hereby established
within the Department of Recreation and Human Resources to advise
the Commissioner on pertinent matters and to perform such other duties
as may be assigned by the Commissioner:
A. Senior Citizens Advisory Committee. There is hereby
created a five-person uncompensated committee to be known as the "Senior
Citizens Advisory Committee." Said Committee shall be responsible
for developing and establishing policy and programs on activities
for the elderly within the Town of Clay and shall assist the Commissioner
in the discharge of his duties regarding said programs and activities.
The members of said Committee shall be appointed annually by the Town
Board.
