It shall be the purpose of this article to promote the public health and to provide for the safe, efficient and economical collection of refuse in and by the Town of Ossining, and all of the provisions of this article shall be construed so as to effectuate that purpose.
A. 
When not inconsistent with the context, words used in the present tense include the future; words in the plural number include the singular number and words in the singular number include the plural number. The word "shall" is always mandatory and not merely directory.
B. 
For the purpose of this article, the following terms, phrases, words and their derivations shall have the meanings given herein:
ASHES
The residue from the burning of wood, coal, coke or other combustible materials.
COMMERCIAL
Any property or area where business, industrial or light manufacturing enterprises are located or operating, or any area not classified as residential.
GARBAGE
Putrescible animal and vegetable wastes resulting from the handling, preparation, cooking and consumption of food; and readily combustible material such as paper, cardboard, wood, excelsior, cloth, food, cans, glass or plastic food containers and bottles.
NEWSPAPER WASTE
Includes newspapers, magazines and other printed material.
PERSON
Any person, firm, partnership, association, corporation, company or organization of any kind.
PRIVATE PROPERTY
Any property other than that used as a public highway.
REFUSE
All putrescible and nonputrescible solid wastes (except body wastes), including garbage, rubbish and ashes.
RESIDENTIAL
An area or dwelling primarily zoned and occupied for residential purposes.
RUBBISH
Nonputrescible solid wastes (excluding ashes) consisting of both combustible and noncombustible wastes, such as yard clippings, metals, wood, glass, bedding, crockery and similar materials.
TOWN
The unincorporated area of the Town of Ossining.
Garbage, ashes and other kinds of refuse shall be placed and maintained in separate containers, except that refuse in the form of newspaper waste shall be placed and maintained for pickup, collection and recycling as hereinafter provided. After adequate notice has been published, posted and publicized for a particular collection area, it shall be mandatory for persons who are owners, lessees or occupants of residential dwellings or commercial property to separately bundle newspapers for pickup, collection and recycling. Said newspaper waste shall be compacted and securely bundled, tied and packed as hereinafter described in § 112-14. When refuse in the form of discarded newspapers is placed within the vicinity of the curb for pickup, collection and recycling, it shall become the property of the Town; and any person, other than an owner, lessee or occupant or representative of the Town or a person acting on behalf of any religious, charitable or veterans organization having a charities registration number with the New York State Department of Social Services, who picks up said refuse for his own use shall be guilty of a violation of this section.
Newspapers shall be compacted and securely bundled, tied or packed so as to be easy to handle and unlikely to scatter. No such bundle or package shall weigh more than 75 pounds, nor shall its dimensions exceed two feet by two feet by four feet.

A. 
The Town shall not be required to collect any refuse which has not been separated and secured in accordance with this article.
B. 
Any person, firm or corporation violating any provision of this article shall, in addition, be guilty of a violation punishable by a fine of not less than $100 nor more than $1,000 or by imprisonment for not more than 15 days, or both.
