Editor's Note: Original § 3 of this local law provided that it "be submitted for approval of the electors at a special election to be held within sixty days alter its adoption and if approved by the affirmative vote of a majority of the qualified electors of the village voting on the proposition for its approval, it shall take effect February first, nineteen hundred sixty-five." Local Law No. 1-1965 was approved at the special election held 1-5-1965.
Section 44 of the Village Law, as last amended by Chapter 737 of the Laws of 1952,[1] as it applies to the Village of Garden City, is hereby changed, superseded and amended to read as follows:
§ 44. Number of Trustees in the Village of Garden City.
  Commencing with the 1965 official year, there shall be seven Trustees in the Village of Garden City.

Section 45 of the Village Law, as last amended by Chapter 538 of the Laws of 1960,[1] as it applies to the Village of Garden City, is hereby changed, superseded and amended to read as follows:
§ 45. Terms of Trustees in the Village of Garden City.
  The six Trustees, three of whom were elected in the year 1963 and three of whom were elected in the year 1964 for terms of two years each, shall continue in office until their terms expire. Their successors shall be elected for two-year terms. At the annual election to be held in the year 1965, one additional Trustee shall be elected for a single term of one year. Thereafter a total of four Trustees shall be elected for a two-year term in the even-numbered years and three Trustees shall be elected for a two-year term in the odd-numbered years.

Subdivision 3 of § 3-300 of the Village Law, as last amended by Chapter 892 of the Laws of 1972, as it applies to the Incorporated Village of Garden City, is hereby changed, superseded and amended to read as follows:

No person shall simultaneously hold an elective and an appointive village office except that: a. not more than two members of the Board of Trustees may be voting members of each board and commission, other than a traffic commission authorized pursuant to § 1603 of the Vehicle and Traffic Law; b. not more than four members of the Board of Trustees may be voting members of a traffic commission authorized pursuant to § 1603 of the Vehicle and Traffic Law; c. members of the Board of Trustees may be single commissioners in charge of village departments except as provided in the zoning article in this chapter.

Subdivision 1 of § 3-308 of the Village Law, entitled "Separate boards of commissioners," as last amended by Chapter 24 of the Laws of 1988, as it applies to the Incorporated Village of Garden City, which section was changed, superseded and amended by Garden City Local Law No. 3-1991, is hereby further changed, superseded and amended as follows:

The Board of Trustees may establish or abolish a board or boards of fire, ambulance, water, light, sewer, park, cultural and recreational affairs or cemetery commissioners or an environmental advisory board or a single municipal board having the powers, duties and responsibilities of two or more such separate boards.
