There is hereby created in the Incorporated Village of Garden City the position of Animal Warden. The Mayor of the Village, subject to the approval of the Board of Trustees, shall have power to appoint such number of Animal Wardens as he may deem necessary to enforce the provisions of Article I of Chapter 55 of this Code. Such Animal Wardens shall be under the jurisdiction and control of the Chief of Police.
The Board of Trustees shall determine the compensation to be paid to each such Animal Warden appointed hereunder and whether each such Animal Warden shall be employed on a full-time or part-time basis.
Such Animal Wardens shall be and hereby are deemed to be "public servants," as said term is used in § 150.20 of the Criminal Procedure Law of the State of New York, for the purposes of issuing appearance tickets returnable in the Village Court for violations of Article I of Chapter 55 of this Code. Appearance tickets issued by such Animal Wardens shall be in the same form as those designated for use by the Garden City Police Department. Use of such appearance tickets by such Animal Wardens shall be solely within the jurisdiction of the Chief of Police. Such Animal Wardens shall also have the authority to stop and temporarily detain animals "running loose," as said term is defined in Article I of Chapter 55 of this Code, for the purpose of determining the owner of such animals.
Such designation of Animal Wardens as public servants for the purposes herein set forth shall not be deemed to confer upon such Animal Wardens any additional powers, duties or responsibilities other than as set forth herein.
