There shall be and there hereby is established a Department of Buildings. There shall be a Commissioner of Buildings who shall be a member of the Board of Trustees and who shall be appointed by the Mayor, subject to the approval of the Board of Trustees, including the Mayor, for such term as the Board of Trustees shall determine by resolution. He shall be the head of the Department, shall have general jurisdiction over and control of the administration of the Department of Buildings and shall have general supervision over the duties performed by and charged by this article to the Department.
A. 
The Building Inspector shall be under the direction of the Commissioner of Buildings. He shall be appointed from a civil service list of positions of Chief Building Inspector in the open competitive class or from such other eligible civil service list of positions in the competitive class as the Civil Service Commission may designate or allocate. The Building Inspector shall be a person who shall have had at least five years of practical experience in and with the construction or design of structures and buildings and in and with building materials or must be a licensed professional engineer or architect.
B. 
The Building Inspector shall be appointed by the Commissioner of Buildings with the consent of the Board of Trustees at a compensation to be fixed by the Board of Trustees. He shall not be removed from office or otherwise subject to any penalty or discipline, except for incompetency or misconduct shown after a public hearing before the Board of Trustees. Said public hearing shall not be held until:
(1) 
After the Building Inspector has been served with a copy of the specific charges preferred against him.
(2) 
At least eight days have elapsed after service thereof, during which time the Building Inspector shall be allowed to serve on the Commissioner of Buildings a written answer to the charges.
C. 
The Building Inspector, except when otherwise directed by the Commissioner of Buildings, shall:
(1) 
Administer and enforce the laws of the state and the Zoning Ordinance of the Incorporated Village of Port Jefferson[1] relating to the construction, alteration or removal of buildings and structures.

(2) 
Receive all applications and issue all permits authorized or required by said Zoning Ordinance relating to the construction, alteration or removal of buildings or structures.
(3) 
Issue all notices and orders and make all inspections which are necessary and proper for the carrying out of his duties and for the administration and enforcement of the provisions of said Zoning Ordinance relating to the construction, alteration or removal of buildings and structures.
The Building Inspector, with the consent of the Commissioner of Buildings, may appoint or employ one or more Deputy Building Inspectors. Their duties shall be determined by the Building Inspector. Their compensation shall be fixed by the Commissioner of Buildings.[1]
