It is the intention of this policy to set forth guidelines for Town personnel concerning the disposition of earthen materials resulting from excavation work, street sweeping, land clearing, road construction, ditching or other such similar activities.
It is the expressed intention that earthen materials be disposed of in the most cost-efficient manner possible. In order to achieve this end, some degree of foresight and planning must be taken by supervisory personnel.
The Road Commissioner shall notify the public through a newspaper of general circulation of the availability of fill within a designated area, giving sufficient time to elicit public response. A list of all persons requesting fill shall be kept and fill disposed of at the nearest and least costly site available. In addition to placing fill on private property, publicly owned land should be considered in determining which site has the best cost advantage.
The Road Commissioner may also make arrangements with individuals who are willing to pay for fill or Town employees who are willing to work on their own time if the arrangements proposed offer a cost advantage to the disposal options listed above.
In the event of an immediate and unplanned-for need to dispose of material, the Road Commissioner shall use good judgment as to the best location to use in disposing of earthen material.
