A. 
There is hereby established a Cable Television Coordinator (CTC) to establish, administer, manage, operate and maintain a cable television access channel facility in the Township effective immediately.
B. 
The Cable Television Coordinator shall be the individual appointed in accordance with Article X of Chapter 26 of the Code of the Township of Manalapan and shall report directly to the Township Administrator for advice, direction and organizational support with technical support and guidance furnished by the Township Cable Television Advisory Committee.
C. 
The Cable Television Coordinator shall have an annual operating budget as determined by the Township Administrator and approved by the Township Committee.
D. 
Funding for the Cable Television Coordinator and production and broadcast facilities will be provided by the Township Committee from fees derived from the Cablevision franchise agreement and other Township resources as may be necessary.
A. 
The Township shall provide educational and governmental (EG) television access facilities and technical support to provide information, educate the public and augment the communications network of the municipality in a noncommercial manner. The broadcast facility will not be used for political broadcasts of any nature except as set forth in § 4-5B. Initially, the cable television production and broadcasting facility will include only the EG capability. At a later date, and upon the recommendation of the CTAC, the Township may consider the implementation of the PEG phase of the programming and production effort. The EG and PEG are separate, and distinct rules, policies, regulations, procedures and standards will individually govern the two phases of the program in accordance with federal, state, county and municipal policies and ordinances.
B. 
EG may be utilized for political debates, provided every qualified candidate agrees in writing to the holding of the debate, the broadcasting of the debate, the date of the debate, the date(s) of the broadcast and the format of the debate. No such debates will be permitted for primary elections.
A. 
The CTC shall serve as EG coordinator, overseeing the Township television production and broadcasting activities.
B. 
No PEG is authorized by this chapter. In the event such authorization occurs in the future, this chapter will be amended to address appropriate regulations.
C. 
The Township Administrator will, on a quarterly basis, advise the Township Committee and CTAC of the progress and any problems being encountered with the cable television production and broadcasting effort.
D. 
The CTC will oversee the operation of the cable television franchise agreement with the cable television provider for the Township. In this capacity, the CTC will also be the Township's interface with the customers of the cable television provider in order to receive and adjudicate any complaints or problems. Problems or complaints deemed to be beyond the scope of resolution for that office will be referred to the Township Administrator or BPU for further action.
E. 
The CTC will interface on a technical/advisory basis with the CTAC in order to keep that Committee apprised of the progress and any problems associated with the cable television effort in the Township. The CTC will attend all CTAC meetings and present a quarterly report to the CTAC for review and guidance prior to presentation to the Township Committee.
The CTC will be responsible to:
A. 
Compile and maintain pertinent historical and technical data, create resident surveys for cable television improvement and the enrichment of the cable television effort.
B. 
Carry out the day-to-day duties of the cable television programming and broadcasting effort.
C. 
Supervise all paid and unpaid staffing in the office of Cable Television Coordinator to include the EG channel, utilizing the contractual commitments of the cable television provider.
D. 
Develop and submit a weekly programming guide for inclusion on the EG channel to the Township Administrator for review and approval prior to the production and airing on the appropriate television channel.
E. 
Establish and maintain all files for at least one year, including a tape library of productions.
F. 
Recommend an annual and, if appropriate, capital budget to the Township Administrator for Township Committee approval and execute an approved budget. Prior to presentation to the Township Administrator, the CTC will review the budget with the CTAC for guidance, input and comment.
G. 
Direct the operations in the EG channel production facility, including supervision of personnel and maintaining all television and broadcast facilities and equipment in accordance with acceptable standards.
H. 
Keep abreast of all federal and state legislation and regulations affecting local televising to insure compliance with applicable laws and regulations.
I. 
Search and develop grant and other funding requests to be submitted to appropriate federal, state and private/corporate philanthropic organizations.
J. 
Making available a bulletin board and all EG programs on the Internet for download by non-Cablevision subscribers.
All users of the EG facilities shall operate under the direct supervision and control of the CTC. With the exception of paid television consultants, if any, and the CTC, all cast, crew, producers, directors, etc., will be unpaid volunteers to the fullest extent possible. Broadcast operators must be at least 14 years of age and have appropriate employment documentation issued by the State of New Jersey Department of Labor or other appropriate agency. All volunteers and access users must undergo and successfully complete orientation sessions, training workshops and user certification tests in associate with Cablevision, Inc., training assistance as applicable.
These procedures apply to all users of the EG channel, including the local public and private school boards. In the event a PEG channel is made operational, separate procedures will be instituted for the PEG channel.
A. 
No program, production or presentation shall be transmitted which directly or indirectly involves any lottery information or which involves a lottery gift, contest, commercial enterprise or similar scheme.
B. 
No program, production or presentation shall be transmitted or permitted to be transmitted which involves obscene or pornographic matter, illicit activity or other unprotected speech, including but not limited to slander, libel and invasion of privacy. The CTC will review and approve all material, descriptions and/or dialogue that will be aired on the EG channel prior to such airing to insure that these regulations are strictly adhered to.
C. 
EG channel transmissions will not be used for political purposes except as noted in § 4-5B. Township Committee meetings, and meetings of committees, boards and agencies created by the Mayor and/or Township Committee for the purpose of performing a governmental function, shall not be deemed to be political in nature, nor shall programming involving a public information topic, special presentation topic or forum of special interest to the public, whose primary purpose is not to promote a political idea or candidate.
D. 
The EG channel will not be used as a medium to promote the passage or defeat of any legislation or public referendum or act proposed by the governing body of the Township, boards of education, local fire districts or any other public entity.
E. 
No advertising may be sold or accepted for viewing on the EG channel. This channel is funded through the office of the CTC. Any material that promotes or is designed to present commercial fund-raising is prohibited with the exception of nonprofit fund-raising events by approved IRS Regulations, Paragraph 501(C)3, organizations which shall be televised on the Community Bulletin Board.
F. 
The Township reserves the right, in its reasonable discretion, to reject any notice designed to solicit names and addresses, which may be used for future commercial fund-raising or gain. Notwithstanding the foregoing, notices announcing the underwriting funding for a production shall not be interpreted as a "commercial use" and, therefore, will be permitted at the end of the televised program.
G. 
In accordance with applicable law, a support or grant originator may underwrite the costs of specific program(s), which can be acknowledged by a brief statement before or after the specific program stating the names of underwriting entity or individuals for no more than 30 seconds. Such credit(s) may contain a logo. However, references to address, telephone numbers, e-mail addresses and/or Web site information or clearly promotional information other than a logo or slogan is prohibited.
H. 
Prior to the transmission of copyrighted material, all appropriate rights, permissions and clearances for usage must be obtained prior to transmission. The Township reserves the right to request evidence of same within its reasonable discretion for record purposes. The CTC will attach a disclaimer to such broadcasting in order to protect the Township from any liability.
I. 
In the event of a question, dispute or complaint regarding the applicability and/or interpretation of these rules and regulations, standards, guidelines and operating procedures, the initial referral shall be resolved by the CTC. Should the matter remain unresolved, referral shall be to the Township Administrator and thence to the Township Attorney for review and resolution.
J. 
All material that is submitted to the CTC shall be duplicate copy and shall become the property of the Township unless a stamped, self-addressed envelope is provided for return of the material. Any material not claimed within 60 calendar days shall become the property of the Township.
K. 
A Community Bulletin Board will be televised on the EG channel on a scheduled basis listing community news, educational material and events, recreation events and newsworthy items, cultural happenings and news, public information material, municipal messages and events, local board of education material and events, school closings, emergency notifications, etc. Information contained in the Bulletin Board will be timely, informational and brief. The messages on the Bulletin Board will be reviewed and purged daily for out-of-date material. Other information that may be included will be date/time/instructions for municipal meetings and events, emergency notifications and municipal news, recycling information and schedules, pertinent information by the Roads and Grounds Department such as road closings, community police notices and notices by local churches and nonprofit organizations of educational and cultural events. All notices must be submitted to CTC in typed form on the organization's letterhead and signed by a responsible official not later than two weeks prior to the desired cable cast viewing. This rule does not apply to emergency notifications, school closings or other events deemed by the CTC to be aired in advance of the two-week restriction. The CTC will develop and provide application forms to be used for Bulletin Board notices. Rules governing the length, repetition, etc., will be printed on the forms. The CTC reserves the right to reject notices not filed in accordance with the rules and regulations of the Township as provided herein or other Township rules and regulations.
L. 
Remote access will be provided to the office of the Chief of Police for emergency notifications of public interest and safety, the local boards of education for school closing information and the office of the CTC for control and monitoring purposes. Any Township organization or affiliate requiring remote access capability must make application by letter to the CTC justifying the request.
