As used in this chapter, the following terms shall have the meanings indicated:
DRIVER
Any person issued a taxicab driver's license pursuant to this chapter who operates a taxicab (operation of taxicab - transporting in a taxicab one or more persons for hire along any of the streets in this City, accepting a passenger to be transported for hire within the City limits or from a point within the City limits to a point outside of the City limits). The "operation of a taxicab," as above described, by one other than the owner of said cab shall be deemed operation by the owner thereof as well as by the person actually driving said cab.
OWNER
Any person who is the named titled holder of any taxicab registered with the New Jersey Division of Motor Vehicles or who is listed in an application for licensure as the owner of a taxicab in the City of Margate.
PERSON
Any individual, partnership, limited partnership, association, corporation, joint venture, lessee, trustee, assigns or receiver, or any other such entity.
STREET
Includes any street, avenue, park, highway, or any other public roadway, whether or not the same is improved.
TAXICAB
Every vehicle, except motorbuses, limousines and motor vehicles commonly called "jitneys," operated by authority of any ordinance, law or permit, which is used or to be used for the common carriage and conveyance of persons for hire from any place within the City of Margate to any other place.[1]

A. 
The licensing, inspection and control of taxicabs and the owners thereof and the enforcement of the provisions of this chapter shall be vested in the Commissioners of the City of Margate.

B. 
The Commissioners may promulgate reasonable rules and regulations affecting the operations use of and inspection of taxicabs, not inconsistent with the provisions of this chapter. Said rules and regulations shall be filed with the City Clerk and shall only be effective upon approval by the City Commission.
C. 
The City Commissioners shall hear all appeals taken from any action or decision of the City Clerk and/or Police Chief.
Every person or persons, firm or corporation found guilty in a municipal court of competent jurisdiction of violating any of the provisions of this chapter shall be liable to pay a fine of not less than $50 nor more than $500 and/or be imprisoned for a period not to exceed 30 days or as may otherwise be provided for in the conviction of a petty disorderly offense in Title 2C of the Revised New Jersey Statutes. Each succeeding day of violation may be construed as a new violation. Two violations within the period of one year may entitle the Board of Commissioners to require forfeiture of all taxicab owners' licenses owned by a licensee.
