A. 
The Chief of Police shall be the head of the Department and shall report to the Public Safety Committee, and through it to the Mayor and Council, for the efficiency and routine day-to-day operations thereof. In the absence or the disability of the Chief of Police, his duties and responsibilities shall be performed by the next senior ranking superior officer of the Police Department.
B. 
In addition, said Chief of Police shall, pursuant to the policies established by the Council:
(1) 
Administer and enforce rules and regulations and special emergency directives for the disposition and discipline of the force and its officers and personnel.
(2) 
Have, exercise and discharge the functions, powers and duties of the force.
(3) 
Prescribe the duties and assignments of all subordinates and other personnel.
(4) 
Delegate such of his authority as he may deem necessary for the efficient operation of the force to be exercised under his direction and supervision.
(5) 
Report at least monthly to the Mayor and Council, through the Public Safety Committee, in such form as shall be prescribed by such authority on the operation of the force during the preceding month, and make such other reports as may be requested by the Mayor and Council through the Public Safety Committee.

A. 
The Deputy Chief of the Police Department shall rank next below the Chief of Police. He shall be assigned to such duties as may be directed by the Chief of Police and/or Public Safety Committee.
B. 
During the absence of the Chief of Police from duty, due to sickness or absence from the Borough of Totowa on leave or special duty, the Deputy Chief shall assume said duties as Acting Chief of the Department. Such designation as Acting Chief shall be forthcoming from the Mayor and Council, in writing, for a specified period of time, or for an indefinite period of time in the event that the period of absence is not specifically known, and during such period he shall exercise the same powers, perform the same duties and be subject to the same rules and regulations as would the Chief of Police.

A Captain of the Police Department shall rank next below the Deputy Chief. He shall be assigned to such duty as may be directed by the Chief of Police and/or Deputy Chief.

A Lieutenant of the Police Department shall rank next below a Captain. He shall be assigned to such duty as may be directed by the Chief of Police and/or Deputy Chief.

A Sergeant of the Police Department shall rank next below a Lieutenant. He shall be assigned to such duty as may be directed by the Chief of Police and/or Deputy Chief.

A patrolman shall perform all duties of a patrolman as shall be established by law and this chapter, by rules and regulations and by general or special orders of the Chief of Police, Deputy Chief and his superior officers.
A. 
The senior ranking officer on duty and assigned to a shift shall be the shift officer unless otherwise designated by the Chief of Police and/or Deputy Chief.

B. 
The shift officer shall remain on duty until properly relieved and shall report to the relieving officer all important police events occurring during his tour of duty, particularly those events that require any following up to be done by his successor.
C. 
He shall not leave his post during his tour of duty except for personal necessity, official duty within police headquarters or upon urgent police business.
D. 
When required to leave his post for any reason or reasons, he shall place a competent member in charge during his absence and shall enter the facts in each case in the form of a memorandum and submit it to the Chief of Police and/or Deputy Chief.

E. 
He shall permit no one to lounge, loiter or otherwise remain in the desk room.
F. 
He shall permit no unauthorized person behind the desk, except a member or employee of the Police Department in the line of duty or the Mayor or member of the Borough Council.
G. 
He shall be responsible for the prompt, neat, accurate and complete recording of all information, reports, records and other data required to be made by him.
H. 
He shall ensure that the telephone, teletype and radio equipment is operating properly and not tampered with, and that all calls and signals are promptly and properly answered.
I. 
He shall promptly attend to all messages received by telephone or otherwise and shall enter the message and the action taken thereon in the appropriate records provided therefor.
J. 
He shall immediately report to the Chief of Police and/or Deputy Chief all unusual and important messages of information received by him.

K. 
He shall be particularly courteous and attentive in listening to all messages received and be tactful and considerate in dealing with all persons and particularly with those who are excited or upset.
L. 
He shall cooperate to the fullest extent with other municipal departments and other law enforcement agencies and shall promptly forward to such departments all reports affecting them.
M. 
He shall be responsible for and shall carefully account for any money and other property taken from prisoners, accident victims or persons finding the same in collections or fines or from whatever source received, listing the property in detail with a description and the money by amount and details of coins and bills, the name and address of the person from whom the property was received and other pertinent data. He shall sign the record and turn such property over to the Chief of Police and/or Deputy Chief or to such custodian as the Chief of Police and/or Deputy Chief may designate.

N. 
The shift officer shall inspect all members reporting for duty or going on post; he shall ensure that each man is properly dressed and is neat in appearance and that he is physically fit and in proper condition to do full duty, and he shall then instruct the members as to any special orders for that particular tour of duty.
O. 
He shall receive the report of each member coming off duty and note the time of the report and the condition of the man and will be held responsible for the acceptance of improper reports. No member who submits a report shall leave the desk until such report has been passed upon and accepted by the shift officer.
P. 
No member of the Department shall be considered to have been properly relieved from duty until such time as he has submitted all the reports required of him during that particular tour of duty and such reports have been passed on and accepted by the shift officer, and the responsibility of neglecting to see that this is carried out shall be vested in the shift officers themselves.
Q. 
He shall promptly report to the Chief of Police and/or Deputy Chief any member late or absent, not in proper condition or not properly dressed or equipped, either when reporting for or off duty.

R. 
He shall cause immediate investigation to be made to ascertain the whereabouts and condition of any member who may fail to report for or off duty.
S. 
He shall investigate, or cause to be investigated, the whereabouts of a member of the Department on duty if said member fails to send in his duty call or answer a radio call.
T. 
He shall promptly report to the Chief of Police and/or Deputy Chief any complaint, report or other evidence of misconduct or neglect of duty or inefficiency on the part of any member of the Department.

U. 
Whenever the shift officer has any reason to suspect a member of the Department of being intoxicated or the driver of a vehicle is taken into custody under suspicion of being intoxicated and legal proof of such condition is desirable or mandatory evidence, he shall immediately notify a trained member of the Department to arrange for a Breather test, Drunkometer test or such other similar test then available to be administered to the suspected person. He shall also obtain the services of a Police Physician or, should one not be available, a qualified substitute physician, for a prompt examination of the suspected person in the event that a scientific test is not available or if, in the shift officer's discretion, he determines the same to be necessary.
V. 
He shall promptly notify the Chief of Police and/or Deputy Chief and the County Physician and Prosecutor's office of the facts in any case of violent or sudden death in the municipality that may come to his attention.

W. 
Upon receiving an alarm of a fire, he shall ascertain the exact location of the fire, immediately notify the Fire Department or Departments concerned and shall detail one or more members of the Police Department to the scene, as the situation dictates.
X. 
When a crime or disorder is reported to him, he shall, take, or cause to be taken, immediate steps to obtain all the facts of the case as quickly as possible.
Y. 
When a person desires to make a complaint against another before the shift officer, the shift officer shall advise him of his right to sign a complaint before the Judge, and, if the case seems urgent, the shift officer shall report the same to the Municipal Court Clerk, if he is not on duty, or otherwise proceed in accordance with law.
Z. 
When persons are being held under arrest or detention in police headquarters, the shift officer shall ensure that the necessary degree of surveillance is placed on such persons to prevent their becoming disorderly or attempting to escape arrest or detention.

A. 
Provision; number authorized; term.
(1) 
Pursuant to New Jersey statutory authority, the Borough of Totowa does hereby provide for the appointment of special law enforcement officers (special officers) of the First and Second Class, sufficient to perform the duties and responsibilities permitted by statute and as shall be assigned by the Chief of Police from time to time.
(2) 
The Department shall be authorized special officers of the First Class not to exceed five and special officers of the Second Class not to exceed eight.
(3) 
Special officers shall be appointed annually by the Mayor and Council, on the recommendation of the Chief of Police, for terms of one year, and said appointments may be revoked by the Mayor and Council for cause after adequate hearing. Special officers so appointed shall not be members of the Police Department.
B. 
Qualifications.
(1) 
No person shall be appointed a special officer unless he:
(a) 
Is a resident of the Borough of Totowa and has been for at least six months preceding the appointment.
(b) 
Is able to read, write and speak the English language well and intelligently and has a high school diploma or equivalent.
(c) 
Is sound in body and of good health.
(d) 
Is of good moral character.
(e) 
Has not been convicted of any offense involving dishonesty or which would make him/her unfit to perform the duties of special officer.
(f) 
Has successfully undergone the same psychological testing that is required of all full-time police officers.
(2) 
The Chief of Police shall have had the applicant fingerprinted as required by statute, conducted a background investigation of the applicant to determine the eligibility and qualifications of the applicant and reported these determinations, in writing, to the Mayor and Borough Council.
C. 
Training course; firearms. No special officer shall commence his duties until he has completed the training as required under N.J.S.A. 40A:14-146.11, or as amended from time to time.
D. 
Uniform. The uniform of special officers shall be determined by the Chief of Police and shall be in compliance with N.J.S.A. 40A:14-146.12.
E. 
Supervision and direction.
(1) 
A special officer shall be under the supervision and direction of the Chief of Police or, in the absence of the Chief, other superior officer designated by the Chief of Police and shall perform his duties only in the Borough of Totowa unless in fresh pursuit of any person pursuant to Chapter 156 of Title 2A of the New Jersey statutes.
(2) 
The special officer shall comply with the rules and regulations applicable to the conduct and decorum of the permanent, regularly appointed police officers of the Borough of Totowa, as well as any rules and regulations applicable to the conduct and decorum of special officers.
F. 
Power and authority of special officers.
(1) 
The Chief of Police may authorize special officers of the Second Class, when on duty, to exercise the same powers and authority as permanent, regularly appointed police officers of the Bureau of Police, including but not limited to the carrying of firearms and the power of arrest, subject to rules and regulations, not inconsistent with the certification and requirements of N.J.S.A. 40A:14-146.11 and 40A:14-146.14.
(2) 
Special officers of the First Class shall be authorized and have the power to issue summons for disorderly persons and petty disorderly persons offenses and violations of Title 39 of the Revised Statutes but shall not be assigned duties which may require the carrying or use of a firearm.
G. 
Hours of employment.
(1) 
The Chief of Police may assign special officers of the First and Second Class to perform authorized duties not to exceed 20 hours per week per officer.
(2) 
Special police officers may be assigned without limit during periods of emergency.
(3) 
The Chief of Police may designate one special officer to whom the limitation of hours set forth in Subsection G(1) of this section shall not apply as provided by N.J.S.A. 40A:14-146.16c.
A. 
Police Physicians shall be required, when directed by the Mayor and Council, to examine and certify to the physical, medical or psychiatric condition of members of the Police Department and applicants for appointment thereto.
B. 
Police Physicians shall be required, at the request of the Chief of Police, Deputy Chief or shift officer, to examine any person who may be charged with an offense of such a nature wherein the testimony of a physician may be required in a prosecution arising from such offense.

C. 
Police Physicians shall be required, at the request of the Chief of Police, Deputy Chief or shift officer, to examine any such person under detention or arrest by the Police Department or who is found to be physically injured at the time of such detention or arrest.

The Chaplains of the Police Department shall visit the sick, injured and dying and minister to the spiritual welfare of the members of the Department.

A. 
School traffic guards shall be appointed for terms of one year, which terms shall expire on December 31 of each calendar year.
B. 
No person shall be appointed as a school traffic guard unless he is:
(1) 
At least 18 years of age.
(2) 
Sound in body and of good health and shall pass a medical examination by a physician designated by the Public Safety Committee.
(3) 
Of good moral character and has not been convicted of any criminal offense involving moral turpitude.
(4) 
A resident of the Borough of Totowa and has been for not less than six months preceding the appointment, or is a resident of the State of New Jersey during the term of appointment.
(5) 
Trained pursuant to the requirements of New Jersey law.
C. 
The school traffic guards shall direct traffic where assigned by the Chief of Police and/or Deputy Chief and shall provide for safe conduct of persons going to and coming from the school.
