The Town of Clarence does hereby adopt all of the provisions set forth in New York State Public Officers Law § 18, and subsequent amendments thereto, relative to the defense and indemnification of officers and employees and authorized volunteers of the Town of Clarence, with the following two (2) exceptions:
A. 
In Subdivision 3(b), pertaining to the rights of employees to be represented by counsel, whether such counsel shall be provided will be determined by a majority of the members of the Town Board of Clarence.

B. 
In Subdivision 8, the Town of Clarence will act as self-insured with respect thereto.

Pursuant to Subdivision 2 of said § 18, the Town Board of Clarence, New York, confers the benefits of said section upon its employees and further directs the liability of such Town for the cost incurred under the provisions of said § 18 of the New York State Public Officers Law.
