It shall be the duty of the Zoning Enforcement Officer to enforce the provisions of this chapter or of any determination of the Board of Appeals or Planning Board.
A. 
Any person violating any provision of this chapter, and the owner and occupant of any premises on which a violation is committed, and any person who shall locate, erect or structurally alter a structure contrary to any statement, specification or plan upon which any certificate or permit was issued shall be guilty of an offense punishable by a fine not to exceed $250 or imprisonment for a period not to exceed 15 days, or both.

B. 
Penalties/adult use entertainment establishments. Notwithstanding any other provisions herein to the contrary, any violation of § 165-14 shall cause the following penalties to apply:

(1) 
Any person, firm, corporation or entity found to be violating any provisions of Local Law No. 2 of the year 1996 shall be served with a written notice by the Code Enforcement Officer, stating the nature of the violation and providing the immediate correction thereof.
(2) 
Any person, firm, corporation or entity who shall violate any portion of this local law shall be guilty of a violation and, upon conviction thereof, shall be fined in an amount not to exceed $500 for each violation. The continuation of a violation of the provisions of this law shall constitute, for each day the violation is continued, a separate and distinct offense hereunder.
(3) 
Any person, firm, corporation, or entity violating the provisions of this chapter shall become liable to the Town for any expense or loses or damage occasioned the Town by reason of such violation.
(4) 
In the alternative, the Town may maintain an action or proceeding in a court of competent jurisdiction to restrain by injunction any violation of this chapter.
(5) 
The penalties and remedies set forth herein are in addition to all other penalties and remedies provided for by law.
Each week's continued violation shall constitute a separate, additional violation.
