A. 
The Mayor shall appoint an Emergency Management Coordinator (Disaster Control Director) from among the residents of the Borough of Fanwood. The Emergency Management Coordinator shall serve, subject to fulfilling the requirements of this section, for a term of three years.
B. 
As a condition of appointment and right to continue for the full term of the appointment, the Emergency Management Coordinator must have successfully completed, at the time of appointment, the then-current approved Civil Defense Director-Coordinator Course. The failure of the Emergency Management Coordinator to fulfill such requirement within the time period prescribed shall disqualify the Emergency Management Coordinator from continuing in that office, and thereupon a vacancy in said office shall be deemed to have been created.
C. 
The Governor may remove the Emergency Management Coordinator at any time for cause. In such event, the Mayor shall appoint a new Emergency Management Coordinator with the approval of the Governor. If the Mayor shall not appoint the Emergency Management Coordinator within 10 days after such office shall become vacant, the Governor may appoint a temporary Emergency Management Coordinator, who shall serve and perform all the duties of that office until such time as a new Emergency Management Coordinator shall be appointed by the Mayor with the approval of the Governor.
There shall be a Deputy Emergency Management Coordinator appointed by the Emergency Management Coordinator with the approval of the Mayor, who shall have the same qualifications as the Emergency Management Coordinator, shall assist the Emergency Management Coordinator and, further, shall assume the functions, powers and duties of the Emergency Management Coordinator in the absence of the Emergency Management Coordinator. Wherever possible, such Deputy shall be appointed from among the salaried officers or employees of the Borough.
A. 
The Emergency Management Coordinator shall be responsible for the planning, activating, coordinating and conduct of disaster control operations within the Borough.
B. 
Whenever, in the Emergency Management Coordinator's opinion, a disaster has occurred or is imminent in the Borough, the Emergency Management Coordinator shall proclaim a state of local disaster emergency within the Borough. The Emergency Management Coordinator, in accordance with regulations promulgated by the State Director, shall be empowered to issue and enforce such orders as may be necessary to implement and carry out disaster control operations and to protect the health, safety and resources of the residents of the Borough.

When any imminent danger to the public peace and order exists in the Borough, including by way of example, but not limited to, riots, disturbances, disorderly assemblages, widespread vandalism or any other situation posing an imminent threat to the people or property of the people of Fanwood, all being against the health, safety and welfare of the people of the Borough, and causes or may cause damage and destruction to property in the Borough, then the Mayor shall have the authority to declare that a state of disaster or emergency exists, and he/she shall have the authority and be empowered to do the following:
A. 
Issue orders or proclamations regulating the hours during which persons shall be prohibited from remaining upon the public streets, ways and places in the Borough.
B. 
Issue orders or proclamations regulating the hours during which vehicular traffic shall be prohibited or restricted from traveling over the streets in the Borough.
C. 
Issue orders or proclamations regulating the hours during which all businesses licensed by the Borough to dispense alcoholic beverages shall be closed.
D. 
Issue orders or proclamations regulating the hours during which all sales of gasoline by gasoline service stations in the Borough shall be closed.
There is hereby created an Emergency Management Defense Council to be composed of not more than 15 members who shall be appointed by the Mayor and shall hold office at the will and pleasure of the Mayor. The Emergency Management Coordinator shall be a member and shall serve as chairman of the Emergency Management Service Council.
A. 
The Emergency Management Defense Council shall assist the Borough in establishing the various local volunteer agencies needed to meet the requirements of all local civil defense and disaster control activities in accordance with the rules and regulations established by the Governor.
B. 
The Emergency Management Defense Council is authorized, within the limits of appropriations, to establish an adequate organization to assist in supervising and coordinating the civil defense and disaster control activities of the Borough. It shall be lawful for the Council's members to also be members of other agencies created because of any emergency.

No representative of the Borough shall request aid in time of disaster directly from noncontiguous municipalities, nor shall the Borough or any public or semipublic agency send personnel or equipment into a disaster-stricken municipality unless and until such aid has been directed by the County Disaster Control Coordinator or his/her deputy. Specific exemptions from the action of this section may be granted only by authority of the State Disaster Control Director.
