155-29 and §§ A204-1 through A204-31 of the Code of the Township of Upper Gwynedd are hereby repealed.
This Part 1 sets forth the compliance requirements
of residents to connect to the sanitary sewer system, the maintenance
of private disposal systems, the prohibition of storm surface runoff
or groundwater drains from connection into the sanitary sewer, the
prohibition of disposal of objectionable waste, the provisions for
approved design and construction permits and the prohibition of connection
to the sanitary sewer unless there is sufficient capacity to convey
and treat the wastewater, setting rental fees and connection charges,
as well as setting forth rules and regulations concerning construction
of building sewers and connections, and to promote the health and
cleanliness, comfort and safety of the citizens of the Township.
As used in this Part 1, the following terms
shall have the meanings indicated:
AUTHORITY
The Upper Gwynedd-Towamencin Municipal Authority.
BUILDING SEWER
The extension from the sewage drainage system of any structure
to the lateral of a sewer.
EQUIVALENT DWELLING UNIT (EDU)
A source of wastewater equivalent to that generated by a
single-family dwelling unit. Every building or use connected to the
sewer shall constitute at least one EDU. For the purposes of residential
uses, the number of EDUs applicable shall consist of the total number
of single-family dwelling units, together with the EDUs applicable
to any common use areas calculated as set forth herein for nonresidential
use. For the purposes of a nonresidential use, the number of EDUs
applicable to that use shall consist of the actual or estimated total
discharge of wastewater per day divided by 280.
HIGHWAY
The entirety of a way or place, of whatever nature, open
to the use of the public as a matter of right for purposes of vehicular
travel, including the unimproved portion of the right-of-way adjacent
to the cartway.
IMPROVED PROPERTY
Any property upon which there is erected a structure intended
for continuous or periodic habitation, occupancy or use by human beings
or animals and from which structure sanitary sewage and/or industrial
waste shall be or may be discharged.
INDUSTRIAL WASTE
Any solid, liquid or gaseous substance rejected or escaping
in the course of any industrial, manufacturing, trade or business
process or in the course of the development, recovery or processing
of natural resources, which is discharged into the sewer system as
distinct from sanitary sewage.
LATERAL
That part of the sewer system extending from a sewer to the
curbline or, if there shall be no curbline, extending 15 feet from
the center line of the street.
NONRESIDENTIAL UNIT
Each connection unit, other than a residential unit, which
is connected to the sewer system and each separately owned or managed
business or professional office or commercial or industrial establishment
within such connection unit which, in each case, is connected to the
sewer system and from which sanitary sewage or industrial waste is
or may be discharged into the sewer system.
OWNER
Any person vested within ownership, legal or equitable, sole
or partial, of any property located in the sewered area.
PERSON
Any individual, partnership, company, association, society,
corporation or other group or entity.
PLUMBING CODE
The Plumbing Code of the Township adopted by Ordinance No.
64-1, as amended by Ordinance No. 64-6, and as hereafter from time
to time further amended or superseded.
RESIDENTIAL UNIT
Each private dwelling; each dwelling unit in a double house
or in a row of connecting houses; each apartment; and each room, group
of rooms, house trailer or enclosure occupied or intended for occupancy
as separate living quarters by a family or group of persons living
together or by persons living alone, which accommodation is connected
to the sewer system and from which sanitary sewage is or may be discharged
into the sewer system.
SANITARY SEWAGE
The type of toilet and other water-carried waste normally
discharged from residential properties.
SEWER
Any pipe or conduit constituting a part of the sewer system
used or usable for sewage collection purposes.
SEWERED AREA
That portion of the Township in which there shall be constructed
a sewage collection system as, from time to time, constructed and
extended by the Authority, the Township or others, and that part of
areas outside the Township in which sewer shall be constructed which
connect to the sewage treatment plant of the Township located in Upper
Gwynedd Township or the Authority located in Towamencin Township.

SEWER SYSTEM
All facilities, as of any particular time, for collecting,
pumping and disposing of sanitary sewage and industrial waste, situate
in the sewered area and owned and/or operated by the Authority or
the Township.
STORMWATER
Any flow occurring during or following any form of natural
precipitation and resulting therefrom.
STREET
Any street, road, lane, court, alley and public square.
TOWNSHIP
The Township of Upper Gwynedd, Montgomery County, Pennsylvania,
or, as the context may require, the Board of Township Commissioners
(in connection with matter requiring action of the Commissioners),
or such officers or employees of the Township as are authorized to
act for the Township in the premises.
USER
Any person who contributes, causes or permits the contribution
of wastewater into the publicly owned treatment works of the Township
or the Authority.

WASTEWATER
The liquid and water-carried industrial or domestic wastes
from dwellings, commercial buildings, industrial facilities and institutions,
together with any infiltrating groundwater, surface water and stormwater
which may be present, whether treated or untreated, which is contributed
into or permitted to enter the publicly owned treatment works.
