There is adopted by the Town for the purpose of prescribing regulations governing conditions hazardous to life and property from fire or explosion, and for the purpose of safety and general welfare, that certain Code known as the National Fire Code, being particularly the 1972 Edition thereof and the whole thereof with amendments and supplements thereto, save and except such portions as are hereinafter deleted, modified or amended. The same are hereby adopted and incorporated as fully as if set out at the length herein. From the date on which this chapter shall take effect, the provisions thereof shall be controlling within the limits of the Town.
As used in the National Fire Code:
BUREAU OF FIRE PREVENTION
The Building Department of the Town and the Office of the Fire Marshal of the state.
CHIEF OF BUREAU OF FIRE PROTECTION
The Building Office of the Town and Fire Marshal of the state and their duly appointed agents and representatives.
CORPORATION COUNSEL
The Town Solicitor.
MUNICIPALITY
The Town of Milton.
A. 
Any person who shall violate or fail to comply with any provision of the National Fire Code or any provision of this chapter, build in violation of any detailed statement of specifications or plans as submitted or approved hereunder or any certificate or permit issued hereunder, and from which no appeal has been taken, and shall fail to comply with such final order as may be affirmed or modified shall, upon conviction, be fined not less than $100 nor more than $500, or be imprisoned for not more than 30 days, or both, and shall pay the cost of prosecution.
B. 
For the purpose of this chapter, each day that a violation continues shall be deemed to be a separate offense.
C. 
The application of any penalty set forth herein shall not be held to prevent the enforced removal of any prohibited condition.
