[HISTORY: Adopted by the Board of Trustees of the Village of Port Washington North 6-13-1988 by L.L. No. 4-1988. Amendments noted where applicable.]
A. 
The Board hereby finds that gasoline, kerosene, diesel motor fuel and/or gasohol retailers are easy targets for holdups because of the enormous volume of cash business consummated at such retailers.
B. 
The Board further determines that crime statistics compiled by the Suffolk County Police Department with reference to robberies that have occurred at gasoline, kerosene, diesel motor fuel and/or gasohol retailers between the hours of 9:00 p.m. and 6:00 a.m. from January 1, 1987, through September 30, 1987, clearly indicate the prevalence of such robberies during the late night hours due to considerations such as lighter traffic.
C. 
The Board also determines that gasoline, kerosene, diesel motor fuel and/or gasohol retailers are unable to get as many people to work these late night shifts as compared to day time shifts because of these crime statistics.
D. 
The Board also finds and determines that it is essentially uneconomical for such retailers to remain open during late night hours except on major highways and thoroughfares despite the existence of "mandatory 24" clauses in certain oil company leases.
E. 
The Board has surveyed the two existing gasoline, kerosene, diesel motor fuel and/or gasohol retailers in the Village of Port Washington North, and said retailers have informed the Board that, for purposes of safety, they would prefer to be closed between the hours of 12:00 midnight and 6:00 a.m. and that such closure would have no adverse effect on their business.[1]

F. 
Therefore, the purpose of this chapter is to require all gasoline, kerosene, diesel motor fuel and/or gasohol retailers within the Village of Port Washington North to be closed for the business of the sale of gasoline, kerosene, diesel motor fuel and/or gasohol between the hours of 12:00 midnight and 6:00 a.m.[2]

No retailer of gasoline, kerosene, diesel motor fuel and/or gasohol located within the Village of Port Washington North shall be open for business between the hours of 12:00 midnight and 6:00 a.m. for the purpose of distributing gasoline, kerosene, diesel motor fuel and/or gasohol to the general public for ultimate consumption at the retail level, regardless of the nature of such other retail or wholesale business activity as may be conducted at such retail business establishment.
Any person who violates the provisions of this chapter, or who shall induce or coerce, or compel someone to violate the provisions of this chapter, shall be guilty of a violation and subject to a fine of not more than $250 and/or 15 days' imprisonment.
