1935 In accordance with § 1023c of the 1935 Supplement to the General Statutes of Connecticut (see now C.G.S. § 30-10) a referendum vote on local option was taken at the annual Town election held on October 7, 1935. The figures on said vote are as follows: permit for all alcoholic liquor: 21 votes; beer permit: 107 votes (passed); no permit: 84 votes.
2003 In accordance with § 30-9 et seq. (Alcoholic Beverages; Local Option) of the 2003 edition of the General Statutes of the State of Connecticut a referendum vote on local option was taken at the biennial Town election held on May 5, 2003. The figures on said vote are as follows: permit for all alcoholic liquor: 815; permits in the following categories: restaurant, grocery beer, package store, cafe, restaurant for catering, and hotel: 746; no permits: 673. All votes cast equal 2,234.
Under C.G.S. § 30-11, for the question regarding all permits to pass, there must be a majority of the total number of votes cast in favor of that question. If there is not a majority of the total number of votes cast for "all permits," then under § 30-11 those "yes" votes for all are added to the votes for enumerated permits to determine whether there is a majority of votes cast for the enumerated permits.
There was not a majority of all votes cast for all permits at the polls on May 5, 2003. However, when, as required by § 30-11, the votes for all permits are added to votes for some (i.e., restaurant, grocery beer, package store, cafe, restaurant for catering, and hotel), a majority of all votes favored some permits. Thus, by virtue of the voting results on May 5, 2003, the following permits are allowed: restaurant, grocery beer, package store, cafe, restaurant for catering, and hotel. Additionally, because of the form of the petitions submitted, Connecticut law provides that permits that were allowed already in the Town of Woodbridge are unaffected by the vote taken on May 5, 2003.
