A sketch shall be submitted by the subdivider as a basis for informal consultation with and suggestions from the Township Commissioners, Township Planning Commission, Township Environmental Advisory Committee, Township Engineer and Delaware County Planning Commission concerning the general layout of the subdivision and for instructions concerning the preparation of the preliminary plan. Ten copies of the sketch plans shall be submitted to the Township Manager, who shall distribute one copy to each of the Township Commissioners and one copy to the Township Engineer, Township Planning Commission, Township Environmental Advisory Committee and the Delaware County Planning Commission for their information and opportunity to comment.
A. 
Procedure. Eleven copies of a preliminary plan, together with the required fee, shall be submitted to the Township Manager. The Township Manager shall forward one copy of the plan to the Township Commissioners, the Township Engineer, Township Planning Commission and Township Environmental Advisory Committee for their review and reports. Submission to any other appropriate county and state agencies shall also take place at this time.

Provided that a preliminary plan has been timely submitted, such plan shall be placed on the agenda of the Township Commissioners for review at a regular meeting not later than 90 days following the date of the regular meeting of the Board of Commissioners or Township Planning Commission, (whichever first reviews the application) next following the date the application is filed, provided that should the next regular meeting occur more than 30 days following the filing of the application, the said ninety-day period shall be measured from the 30th day following the day the application has been filed.

(2) 
The Township Commissioners shall approve, approve with conditions or disapprove any preliminary plan at the regular meeting at which such plan is placed on the agenda. However, no action shall be taken by the Township Commissioners with respect to a preliminary plan until written reports from the Township Engineer, Township Planning Commission, Township Environmental Advisory Committee and Delaware County Planning Commission are received and considered or until such time for review has expired.
(3) 
Preliminary approval, conditional approval or disapproval of a preliminary plan by the Township Commissioners shall include written findings upon any element found contrary to the provisions or intent of the Subdivision Ordinance and/or the Subdivision Regulations.
(4) 
In reviewing the application, the Township Commissioners may secure the advice or assistance of one or more expert consultants qualified to evaluate all the implications of the proposed development and advise as to any conditions and safeguards that should be prescribed to assure the fullest achievable compatibility between the proposed use, its neighborhood and the community as a whole. The fees charged by any such expert consultants shall be paid for by the subdivider.
(5) 
Approval or conditional approval by the Township Commissioners is tentative and is not binding if subsequent study, information or construction details warrant modification.
(6) 
Approval or conditional approval of a preliminary plan shall be effective for one year, unless extended by the Township Commissioners. If a final plan is not approved within such one-year period, the preliminary plan must be resubmitted for preliminary approval as a new subdivision.

The Township Commissioners shall act at such regular meeting to approve, approve with conditions or disapprove the final plan. However, no action shall be taken by the Township Commissioners with respect to a final plan until written reports from the Township Engineer, Township Planning Commission and Township Environmental Advisory Committee are received unless such time for review has expired. If approved with further conditions or if disapproved, the Township Commissioners shall specify, in writing, any element found contrary to the provisions or intent of the Subdivision Ordinance and/or Subdivision Regulations.

B. 
Permit.
(1) 
Upon approval of the final plan, the Township Manager shall allow the issuance of a building permit after proper application.
(2) 
The building permit shall authorize the subdivider to construct the improvements in accordance with the approved final plan.
(3) 
The building permit shall not constitute or imply approval by the Township of the work to be performed thereunder.
(4) 
The building permit shall become null and void if the work for which granted is not commenced within six months from the permit date; provided, however, that such permit may be extended for a further period of six months upon written application to and approval by the Township Commissioners.
(5) 
When the work for which the building permit was issued has been completed in accordance with all requirements pertaining thereto, the Township Manager shall issue a certificate to that effect, and the Township Engineer shall endorse the final plan accordingly.
C. 
Recording of plan. Within 90 days of the date of approval, the subdivider shall record the final plan in the office of the Recorder of Deeds of Delaware County. Any recording fee shall be paid by the subdivider.
D. 
Final plan becomes part of Comprehensive Plan. After a subdivision plan has been duly recorded, the streets, parks and other public open spaces or improvements shown thereon shall be considered to be part of the Township's Comprehensive Plan.
E. 
Streets, parks and other improvements private until dedicated or condemned. Every street, park or other public open space or improvement shown on a final plan that is recorded as provided herein shall be deemed to be a private street, park, open space or improvement until such time as the same has been offered for dedication to the Township and accepted by ordinance or resolution or until it has been condemned for use as a public street, park, open space or improvement.
