The Pen Argyl sewage treatment plant and the collection system within and outside Pen Argyl Borough boundaries are owned by the Pen Argyl Municipal Authority ("Authority"). Through an agreement between the Authority and Pen Argyl Borough (the "Borough"), the Borough is responsible for the day-to-day operation and maintenance of the sewage treatment plant and collection system.
The Borough of Pen Argyl, Northampton County, Pennsylvania, is a municipal corporation of the commonwealth, acting by and through its Council or, in appropriate cases, acting by and through its authorized representatives.
The Authority is an authority existing under and governed by the Pennsylvania Municipality City Authorities Act of 1945, approved May 2, 1945, P.L. 382, as amended and supplemented (the Authorities Act).[1]

The purpose of this chapter is to establish rules and regulations for the operation and maintenance of the sewer system.
This chapter shall be referred to as the "Pen Argyl Borough Sewage Procedures Manual."
The Authority is the owner of the sewage treatment plant and collection system, both within and outside the Borough. The Borough is the operator of the system. The Borough has management control and operational control with respect to all matters within the Borough limits. The Authority has control outside the Borough, though the Borough is authorized to act as the agent of the authority with respect to operational matters outside the Borough limits.
