The National Electrical Code, 2005 Edition, together with any subsequent amendment, change or supplement thereto as may be adopted by the DCA, is hereby adopted in and for the Township of Toms River.
Notwithstanding anything to the contrary herein provided, the provisions of the International Building Code, NJ Edition, Ordinance No. 1236 and amendments thereto, shall govern in any conflict between the provisions thereof and those herein contained.[1]

No certificate of occupancy shall issue for any building, structure or use included within the requirements of the code unless an inspection has been made and approval received from any inspection authority authorized to make such inspections by the Board of Public Utility Commissioners of the State of New Jersey (PUC). However, nothing contained herein shall preclude the Code Enforcement Officer from having concurrent jurisdiction for inspections to be made and enforcement of this chapter.
Any violation of the provisions of this chapter shall be punishable by a fine of not more than $2,000 or by imprisonment for not more than 90 days, or both. Such penalties shall not be exclusive, and in addition thereto any violation may be abated by a civil action instituted in a court of competent jurisdiction.
Three copies of the said code entitled the "National Electrical Code, 2005 Edition," as prepared and published by the National Fire Protection Association, marked with the amendments and deletions hereinabove set forth, are to be filed in the office of the Township Clerk of the Township of Toms River and shall remain on file there for use and examination by the public.
