The office of Township Manager is hereby created.
The Manager shall be appointed for an indefinite term by a majority of all the members of the Board of Supervisors. The Manager shall serve at the pleasure of the Board of Supervisors and may be removed at any time by a majority vote of all its members, subject to the terms of any applicable employment contract. At least 60 days before such removal becomes effective, the Board of Supervisors shall furnish the Manager with a certified mail notice of intent of removal.
The Manager shall be chosen on the basis of executive and administrative abilities, with special reference to his actual experience in or knowledge of accepted practices in respect to the duties of the office as herein outlined. Formal training with emphasis in public administration and/or business administration is required. Formal training, however, may be waived in lieu of experience. The Manager need not be a resident of the Township of Derry or Commonwealth of Pennsylvania at the time of appointment, but as soon as possible thereafter shall become and during tenure shall remain a resident of the Township. Such alternatives of qualification may be established as the Board of Supervisors may find appropriate and acceptable.
Before entering upon his duties, the Manager shall give a bond to the Township with a bonding company as surety, to be approved by the Board of Supervisors in such sum as it may require, as fixed by resolution of the Board of Supervisors from time to time, conditioned for the faithful performance of duties. The premium shall be paid by the Township.

A. 
The Manager shall be the chief administrative officer of the Township and shall be responsible to the Board of Supervisors as a whole for the proper and efficient administration of the affairs of the Township. The Manager's powers and duties shall relate to the general management of all Township business not expressly by statute imposed or conferred upon other Township officers.
B. 
Subject to recall by ordinance of the Board of Supervisors, the powers and duties of the Township Manager shall include the following:
(1) 
The Manager shall supervise and be responsible for the activities of all Township departments operating directly under the Board's authority including, but not limited to, police, public works, engineering, community development, parks and recreation and administrative services and shall have general oversight responsibility and coordinate all Township activities operating indirectly under the Board's authority including, but not limited to, the library; however, operations are the direct responsibility of the respective department heads.
(2) 
The Manager shall nominate for appointment, assign and define the qualifications and duties of all department heads subject to the approval of the Board and shall recommend assignments and transfers of such employees as the interests of the Township may dictate. The Manager shall have the authority to employ persons to fill nondepartmental head vacancies, but shall notify the Board of Supervisors with such relevant information as he shall deem advisable to keep the Board informed, or as the Board shall from time to time request. The Manager shall report to the Board the case of any employee whose service is unsatisfactory and shall take appropriate action in accordance with applicable statutes, ordinances, employment contracts and shall annually present, at least 120 days before the end of the calendar year, a performance evaluation resume of all department heads and shall see that performance evaluation resumes are submitted on all employees by their respective department heads.
(3) 
The Manager shall prepare and submit to the Board of Supervisors, according to an approved budget calendar, an annual operating budget for the next fiscal year and an explanatory budget message. In preparing the budget the Manager shall obtain from the head of each department, appropriate board or officer, estimates of revenue and expenditures and other supporting data as appropriate. The Manager shall be responsible for implementing the Board approved budget and shall establish and maintain efficient procedures and effective controls for all expenditures of funds in accordance with the adopted budget subject to the direction and approval of the Board of Supervisors.
(4) 
The Manager shall maintain adequate business and property records, personnel and demographic records, and shall act as custodian of such records and all contracts, securities, documents, title papers, books of records and other papers belonging to the Township.
(5) 
The Manager shall also be the purchasing officer of the Township and shall make said purchases in accordance with the provisions of the Second Class Township Code, 53 P.S. § 65101 et seq., and in compliance with applicable resolutions as established from time to time by the Board of Supervisors.
(6) 
The Manager shall receive prior notice of all meetings of the Board of Supervisors or its committees.
(7) 
The Manager shall prepare the agenda for each meeting of the Board of Supervisors and shall prepare and submit recommendations relative to all matters requiring Board action placing before the Board such necessary facts, information and reports as are needed to ensure the making of informed decisions.
(8) 
The Manager shall keep the Board of Supervisors informed as to the conduct of Township affairs, submit monthly and other designated reports on the condition of the Township finances and shall present other such reports at the Board of Supervisors request and shall delegate to representative, administrative and department heads the processing and submission of all required reports adopted as part of the monitoring and control procedures for the Township.
(9) 
The Manager shall submit to the Board of Supervisors, after the close of each fiscal year, a complete up-to-date report on the financial and administrative activities of the Township for the preceding year.
(10) 
The Manager shall provide suitable instructions and regulations to govern the use and care of Township properties.
(11) 
The Manager shall advise the Board on the need for new or revised policies and ordinances and see that all policies and ordinances of the Board are implemented.
(12) 
The Manager shall direct all communications of the Board of Supervisors to employees and shall receive from employees all communications and matters to be made to the Board.
(13) 
The Manager shall supervise the effective administration of all institutional or statutory laws, state and charter regulations and Board policy. Moreover, the Manager shall see that the provisions of all franchises, leases, permits and privileges granted by the Township are observed.
(14) 
The Manager shall be an official representative of the Township in its dealings with other government entities, institutions, agencies, community organizations and the general public.
(15) 
The Manager shall attend to the letting of contracts with prior approval of the majority of the Board of Supervisors in due form of law and the Manager shall supervise the performance and faithful execution of the same except insofar as such duties are expressly imposed upon some other Township officer by statute.
(16) 
The Manager shall act on his own discretion, if timely action is necessary, on any matter not covered by policy but shall report such action to the Board as soon as practicable and recommend a policy to provide guidance in the future.
(17) 
The Manager shall employ, by and with the approval of the Board of Supervisors, experts and consultants to perform work and to advise in connection with any of the functions of the Township.
(18) 
The Manager shall perform such other tasks as from time to time are assigned by the Board of Supervisors though not explicitly expressed in ordinance.

The Manager shall be evaluated 90 days prior to the end of the calendar year for the faithful performance and discharge of his powers and duties.

The salary of the Township Manager shall be fixed from time to time by resolution of the Board.
If the Manager becomes ill or needs to be absent from the Township, the duties of the Township Manager shall be performed by another employee of the Township designated by the Township Manager; however, the person so designated shall not perform these duties for a period longer than two weeks without the approval of the Board of Supervisors.
