A. 
Water Department. The Commissioner is responsible to ensure that water of questionable or unsuitable quality does not enter the public water supply system. The Commissioner shall determine the degree of hazard that a consumer facility poses to the district water system and shall require that a suitable backflow prevention containment device be installed, tested, operated and maintained and that adequate record of maintenance and repair be kept. The Commissioner, or his/her authorized designee, shall have the authority to collect penalties and disconnect service for failure to comply with annual inspection requirements and notices submitted to owners requiring corrective action.
B. 
Owner.
(1) 
The owner or user of water from the system of the water district shall be responsible for the elimination or protection of all cross-connections on his premises.
(2) 
If required by regulations adopted pursuant to this Part 3 or by written order of the Commissioner, the owner shall, at his expense, install, maintain and test any and all backflow prevention devices on his premises.
(3) 
The owner shall install backflow prevention in a manner approved by the Commissioner and shall periodically test all backflow prevention devices as provided for in the Water District Administrative Procedures and Technical Standards. Testing shall be conducted by certified backflow prevention device testers on an annual basis and such reports shall be submitted to the Water Department each year by September 1. Late submissions of the annual inspection report shall be subject to an additional $50 administrative processing fee to be added to the next water bill. Owners that fail to submit an annual inspection report to the Water Department by the first of September may be subject to penalties pursuant to § 131-67 of this chapter, have such penalties added to their water bill, and may have their water supply cut off as determined by the Commissioner.

Administrative procedures and technical standards shall be adopted by the Town Board pursuant to resolution after public hearing. The Commissioner will operate a cross-connection control program, including the keeping of necessary records to fulfill the requirements of this regulation.
B. 
The district, through its properly authorized agents and assistants, may request and, upon the consent of the customer, may enter the premises of any customer who is supplied with water to examine the pipes and fixtures, backflow prevention devices, the quantity of water used, the manner and nature of water used, types of stored materials, supplies and products, processes, private wells, swimming pools, underground lawn irrigation systems, fire sprinkler systems, solar heating systems or any other products or processes which may endanger the quality of the district's water supply. Alternatively, the customer may have such an inspection performed by a professional engineer or architect licensed and registered in New York State who would certify the results of the inspection to the district.
C. 
Water service may be discontinued by the district for refusal to grant access for the aforementioned purposes: where the district has a reasonable basis to believe, from the nature or use of such premises, that a determination should be made as to the existence, nonexistence or degree of contamination hazard; or where the activities there are comparable or similar to those of typical establishments listed in the State Department of Health guidelines as requiring protective devices. However, the customer will not be subject to discontinuance if, upon the refusal to provide access, he provides a certification by a professional engineer or architect licensed and registered in New York that a backflow prevention device that meets the requirements of the district and the State Department of Health has been installed or, in the alternative, the customer provides a certification by a professional engineer or architect licensed and registered in New York State that such device is unnecessary at the premises. Such certification must be to the satisfaction of the Commissioner.
D. 
Upon evaluation of the inspection reports, the Commissioner will inform the owner by letter of any corrective action deemed necessary, the method of achieving the correction and the time allowed for the correction to be made. Such irregularities disclosed shall be cause for discontinuing service unless corrected by the consumer within 90 days after written notice is given by the Commissioner; however, if the Commissioner determines at any time that a serious threat to the public health exists, the water service will be terminated immediately and notice given to the owner as soon as reasonably practical.
