In any instance in which a developer's agreement has been executed in connection with a development and the said developer's agreement is in default, any purchaser of any lot or lots constituting a part or the whole of the development shall be required, as a precondition to the issuance of any permit on the subject lot or lots, to execute a supplemental developer's agreement in a form to be approved by the Municipal Attorney as to legal sufficiency and by the Mayor and Council as to substantive content.
