§ 11-1 Establishment as public utility.

The Township Council of the Township of Evesham does hereby declare and establish that the Municipal Golf Course of the Township of Evesham, commonly known as "Indian Spring," shall hereafter be operated and maintained as a self-liquidating public utility for all purposes of the Local Bond Law and Local Budget Law of the State of New Jersey.[1] Said golf course enterprise, together with all inventory, accounts receivable, contracts or other personalty, shall hereafter be the property of said utility.

§ 11-2 Fees and charges; membership rates.

The golf course utility is hereby authorized to receive such fees, rents, rates or other charges for or in connection with the use or services of such municipal public utility, which sums shall be held, used and applied in accordance with the Local Bond Law and the Local Budget Law of the State of New Jersey as well as other applicable statutes.[1] Said fees, rents, rates or other charges shall be kept on file with the Golf Course Business Manager, subject to review and approval by the Township Council.

Municipal Partners Program.

There is established a Municipal Partners Program to provide residents of other Burlington County municipalities the opportunity to play reduced-rate golf at Indian Spring Golf Course in exchange for the partner municipality advertising the golf course and the partnership through website, social media and live community events according to the terms of a partnership agreement between the municipalities. Residents of partner communities shall receive a reduction of $5 in green fees from the posted nonresident rate from opening until 5:00 p.m., excluding senior rates, nine-hole rates and league rates as these rates are already equal to resident rates.

Discounts of instruction rates: Market conditions and consumer preference can often lead to negotiation of golf lesson rates, as there is a great amount of competition with other golf professionals at other facilities. Each instructor is allowed to negotiate his or her rate no greater than 10% in order to attract more business. Any discount greater than 10% must be approved by the Director of Golf.
Group lessons are defined as four or more individuals for a single session. Multiple, repeating sessions are not classified as group instruction, unless a new fee is paid at the time of each group lesson. Group lessons can be discounted no more than 10% off the hourly rate.
F. 
Affinity programs. The golf course has unique opportunities to enter into agreements with local businesses, corporations and/or foundations that can mutually benefit both parties. Under the direction of the Township Manager, the Director of Golf shall have the authority to negotiate arrangements with discounts of not greater than 30% off greens fees, range balls, and/or merchandise in order to attract additional business. Each affinity program negotiated shall be presented to Council for approval and will follow the pricing outlined herein. The discounts and programs associated in each arrangement are only valid for the dates of the resolution and/or contract negotiated by the Director of Golf. The benefit to these arrangements is primarily public relations and marketing of both parties.

§ 11-3 Management.

A. 
Management of the utility hereinabove established shall be vested in the Township Manager of the Township of Evesham. There is hereby delegated to the Township Manager the power to establish reasonable rules and regulations governing the utility and its operations.
B. 
The Township Manager is authorized to discount golf course fees up to 20% to attract golf outings and for the promotion of food and beverage specials with the contracted caterer.[1]
