Whenever a space is marked off on any street for the parking of an individual vehicle, every vehicle parked there shall be parked wholly within the lines bounding that space, and it shall be a violation of this article for any person to park a vehicle or allow it to remain parked otherwise.

A. 
Findings and purpose. The Township finds that:
(1) 
Certain residential areas in the Township are subjected to commuter vehicle parking, therefore depriving the residents of those areas of spaces in which to park their own vehicles.
(2) 
Those residential streets are also subjected to a high degree of commuter traffic which substantially reduces the quality of the ambient air level.
(3) 
The establishment of a parking permit program for certain affected areas should facilitate efficient movement of traffic by providing for parking preference during certain hours of the day and days of the week. Therefore, the Township considers it to be in the interest of the people of the Township to provide for the establishment of a residential permit parking program to ensure primary access to available parking spaces by neighborhood residents and also to provide a cleaner ambient air level.
B. 
Definitions. For the purpose of this section, words and terms listed in this subsection, as follows, shall have the following meanings:
COMMUTER VEHICLE
A motor vehicle parked in a residential area by a person not a resident of that residential area.
PROPRIETOR
A person who owns or leases real estate within a residential area of which he is not a resident, but who owns or manages a business enterprise or professional office maintained at that address; for the purpose of this section, a proprietor shall be entitled to one parking permit for that business or professional office address.
RESIDENT
A person who owns or leases real property within a residential area and who maintains either a voting residence, or bona fide occupancy or both, at that address.
RESIDENTIAL AREA
A contiguous area containing public highways or parts of public highways primarily abutted by residential property or residential and nonbusiness property (such as schools, parks, places of worship, hospitals and nursing homes).
C. 
Criteria. The residential areas designated in Subsection D of this section are those deemed impacted and hence eligible for residential parking on the basis of the following criteria:
(1) 
During any period between the hours of 7:00 a.m. and 6:30 p.m., Monday through Saturday, except legal holidays, the number of vehicles parked (or standing), legally or illegally, on the streets in the area is equal to 70% or more of the legal, on-street parking capacity of the area. For the purpose of this criterion, a legal parking space shall be 20 linear feet.
(2) 
During the same period as specified in Subsection C(1), directly above, 10% or more of the vehicles parked (or standing) on the streets in the area are not registered in the name of a person residing in the area. For the purpose of this criterion, the latest available information from the Bureau of Motor Vehicles and Licensing of the Pennsylvania Department of Transportation regarding registration of motor vehicles shall be used. Provided, in determining that a specific area identified as impacted and eligible for residential permit parking is designated as a residential permit parking area, the following factors are taken into consideration:
(a) 
The local and metropolitan needs with respect to clean air and environment.
(b) 
The possibility of a reduction in total vehicle miles driven in the Township.
(c) 
The likelihood of alleviating traffic congestion, illegal parking and related health and safety hazards.
(d) 
The proximity of public transportation to the residential area.
(e) 
The desire and need of the residents for residential permit parking and their willingness to bear the administrative costs in connection with it.
(f) 
The need for parking in excess of the residential permit parking program in proximity to establishments located in the residential permit parking area and used by the general public or religious, health or educational purposes.
D. 
Designation of residential permit parking areas.
(1) 
The following are designated as residential permit parking areas:

Signs shall be erected along the streets in each residential permit parking area, including the days, hours, locations and conditions under which parking shall be by permit only.
E. 
Application for permit. Application for a residential parking permit shall be made to the Chief of Police by the person desiring the permit, who shall be only the owner or the driver of a motor vehicle who resides on or is a proprietor of property immediately adjacent to a street or other location within a residential parking permit area. A separate application shall be required for each motor vehicle, and each application shall be accompanied by a $10 permit fee, which shall be for the use of the Township, to be applied to the cost of administering the residential permit parking program. Each application shall contain the following information: the name of the owner; the driver of the motor vehicle; the address of the resident or the proprietor; the make, model, color and registration number of the motor vehicle; and, the driver number as taken from the applicant's current driver's license. At the discretion of the Chief of Police, the applicant shall be required, at the time of making application, to present his driver's license and the vehicle registration card.
F. 
Issuance of permit. Upon receipt of the application and the permit fee, and determination that the information upon the application shows that the applicant is entitled to a residential parking permit, the Chief of Police shall issue to the applicant a residential parking permit, which shall be valid for the remainder of the calendar year. The permit shall display the serial and registration numbers of the motor vehicles, the residential parking area number and the expiration date. The permit shall be renewable annually before the expiration date, upon making application for renewal and payment of the $10 permit fee. It shall be unlawful and a violation of this section for any person to display other than the current and valid permit while standing or parking in a residential permit parking area at any time when those permits are to be displayed.
G. 
Temporary and exemption parking permits. Temporary parking permits may be issued by the Chief of Police, upon payment of a fee of $2, to bona fide visitors of residents of a designated residential permit parking area, and exemption parking permits may be issued, without payment of a fee, to handicapped persons.
H. 
Responsibility of permit holder.
(1) 
Notwithstanding any provision of this section to the contrary, the holder of a residential parking permit shall be permitted to stand or park a motor vehicle operated by him in any designated residential parking area during those times when parking of motor vehicles is permitted in that area. While a vehicle for which a residential parking permit has been issued is so parked, that permit shall be displayed so as to be clearly visible through the windshield of the vehicle. A residential parking permit shall not guarantee or reserve to the holder a parking space within a designated residential permit parking area.
(2) 
A residential parking permit shall not authorize its holder to stand or park a motor vehicle in any place where or at any time when stopping, standing or parking of motor vehicles is prohibited or set aside for other specified types of vehicles, nor shall the permit exempt its holder from the observance of any traffic or parking regulation other than residential permit parking regulation or restriction.
(3) 
No person other than the permit holder whose name appears on the permit shall use a residential parking permit or display it on a vehicle operated; any such use or display by a person other than the permit holder shall constitute a violation of this section by the permit holder and by the person who so used or displayed the parking permit.
(4) 
It shall constitute a violation of this section for any person falsely to represent himself as eligible for a residential parking permit or to furnish false information in a application to the Chief of Police in order to obtain a residential parking permit.
(a) 
Revocation of permits. The Chief of Police shall have authority to revoke the residential parking permit of any permit holder found to be in violation of any provision of this section. Upon written notification to him of the revocation, the permit holder shall surrender the permit to the Chief of Police. Failure to do so, when so requested, shall constitute a violation of this section. Provided, any person receiving such a notice, may, within 10 days after the date of the notice, appeal to the Board of Supervisors for a hearing on the revocation, and the decision of the Board of Supervisors shall be final.
It shall be illegal to park a tractor, truck-tractor in combination or any truck larger than a pick-up truck of 9,000 GVW in front of the Municipal Building parking lot adjacent to Hockersville Road. It shall be illegal to park a vehicle in front of the Municipal Building parking lot adjacent to Hockersville Road in the following designated areas:
A. 
Fourteen-foot-wide areas in front of the entranceways to the Municipal Building.
B. 
Parking spaces designated "police parking only" or indicated to be reserved for the parking of Township officials.
C. 
Any of the driveway areas including the entranceway and exitway of the parking lot.

A. 
Definition: An unobstructed area immediately adjacent to and surrounding all buildings open for public use. Such lanes shall be a minimum of six feet in width and are reserved for use by "emergency vehicles" as defined in the Pennsylvania Vehicle Code, 75 Pa.C.S.A. § 102, which section, in pertinent part, is incorporated herein by reference thereto.
B. 
It shall be deemed a violation of this section for any person, firm, corporation or partnership to stop, stand or park a motor vehicle or other vehicle, barricade or otherwise block such lanes at any time and thereby hinder or prevent the passage, entrance or exitways to, in, about or out of any public building or place occupied for public use whether upon public or private property.
C. 
As they deem necessary and upon the recommendation of the Township Police Department or the Hershey Fire Company, the Board of Supervisors may add additional fire lane areas by motion and resolution.
D. 
Pavement and curb markings delineating the fire lane area shall be made and maintained at the expense of the property owner or occupant. Such markings shall be approved by the Township Police Department. The Township shall erect, position and maintain approved signs which clearly prohibit the stopping, standing or parking of a vehicle within the established fire lanes.
E. 
The following areas are designated as fire lanes:
(1) 
Briarcrest Square Shopping Center.
(a) 
Said fire lane shall begin at the intersection of the northeast parking lot of the Briarcrest Square Shopping Center where the entrance and exit intersects on Briarcrest Drive. The fire lane shall extend in a southeasterly direction for approximately 422 feet adjacent to the rolled concrete curb line bordering Briarcrest Square Shopping Center Stores #3, #8, #9, #10, #11, and #26, as indicated on Derry Township's Development Place No. 077, where it terminates at the entrance and exit intersection for the northeast parking area onto Centerview Drive. The fire lane shall extend perpendicular to the rolled concrete curb for a distance of six feet into the paved cartway.
(b) 
Said fire lanes shall commence at the entrance and exit intersection of the Centerview Drive for the southeast parking lot area of the Briarcrest Square Shopping Center and extend in a westerly direction bordering Stores #16 and #18 as indicated on Derry Township's Development Plan No. 077, for a distance of 141 feet where it terminates on the east side of Store #16. The fire lane shall extend perpendicular to the rolled concrete curb bordering Stores #16 and #18 for a distance of six feet into the paved cartway.
(2) 
Cocoa Avenue Plaza. Said fire lane shall begin at the northwest corner of the Cocoa Avenue Plaza building and extend in an eastwardly direction for approximately 60 feet to the northeast perpendicular from the concrete curb for a distance of 20 feet into the paved cartway.
(3) 
Derrytown Mall Shopping Center. Said fire lanes shall start at the furthest southeastern point of the mall and extend to the north, 225 feet adjacent to and directly in front of the various places of business in the mall. The fire lane area shall extend perpendicular to the concrete curb for a distance of six feet bordering the trafficway.
(4) 
East Granada Avenue. Said fire lane shall begin at a point 162 feet east of "H" Street to a point 40 feet east thereof and a point 158 feet east of this point to a point 40 feet east thereof.
(5) 
Evangelical Free Church of Hershey. Said fire lane shall begin at a point of the Free Church and a point 72 feet south of Hilltop Road. Said fire lane shall be 18 feet wide and extended 292 feet in a southerly direction, running parallel to the curbline which is directly east of the church building.
(6) 
Giant Food Store. Said fire lane shall begin at the northwest corner of the Giant Food Store building and extend in an easterly direction for approximately 243 feet to the northeast corner of said building and thence shall extend in a southerly direction to a point approximately 62 feet south thereof. The fire lane area shall extend perpendicular from the building for a distance of 12 feet into the paved cartway.
(7) 
Hershey Park Arena.
(a) 
Said fire lane shall begin at the southeast corner of the Hershey Park Arena parking lot available for public use and extend westerly among the southern border of the macadam lot for a distance of 192 feet. The fire lane shall extend in a perpendicular direction from this parking lot border into the parking lot trafficway for a distance of approximately 54 feet. The fire lane will be designated by a combination of posted signs and pavement markings.
(b) 
Said fire lane shall also extend northward from the north edge of the fire lane established in Subsection E(7)(a) above, for a distance of 197 feet, and it shall extend in a perpendicular direction to the eastern border of the macadam lot into the trafficway for a distance of 28 feet. The fire lane will be designated by a combination of posted signs and pavement marking.
(8) 
Hershey Plaza Highrise.
(a) 
Said fire lane shall begin at the entrance to the cartway from Mill Road on the western side thereof and shall encompass the entire paved cartway from the edge of the pavement of Mill Road to a point approximately 180 feet west thereof and back again to the entrance. Delineation of this fire lane area is indicated on the map available in the Township Office, marked Exhibit A, and incorporated herein by reference thereto.
(b) 
Said fire lane shall also begin at a point approximately 112 feet west of the northeast corner of the building and extend in a westerly direction to a point approximately 35 feet west thereof. The fire lane shall extend perpendicular from the concrete curb for a distance of 20 feet into the paved parking lot. Delineation of this fire lane area is indicated on the map available in the Township Office, marked Exhibit A, and incorporated herein by reference thereto.
(c) 
Said fire lane shall begin at Lot 1-A entrance and continue south to Box Officer No. 1 entrance on both the east and west side of the service road.
(d) 
Said fire lane shall begin at the southeast corner walkway and continue west to the rear center arena entrance extending perpendicular from the arena building for a distance of 28 feet.
(e) 
Said fire lane shall begin on the south side of the arena at the Foods loading dock and continue west to the southwest corner of Central Plant; then continue from the southwest corner of Central Plant north for a distance of 70 feet. Said fire lane shall extend perpendicular from the building for a distance of 10 feet and include the area of any access driveway adjacent to any building this fire lane encompasses.
(f) 
Said fire lane shall begin at Gate No. 1 and continue north side to Central Plant, including any portion of the access driveway perpendicular to this fire lane.
(g) 
Said fire lane shall begin at Gate No. 1 and continue on the south side to a point 528 feet east thereof.
(9) 
Hershey Postal Facility and Office Building. Said fire lane shall begin at the southwest corner of the Hershey Postal Facility and Office Building and extend along the south wall in an easterly direction for approximately 93 feet to the southeast corner of said building. The fire lane area shall extend perpendicular from the south wall of said building for a distance of 13 feet into the roadway pavement of North First Street.
(10) 
Hershey Public Library. Said fire lane shall begin at a point 316 feet in from the main entrance to the library off of Cocoa Avenue. From this point, the fire lane shall extend 492 feet from the northwest curb line adjacent to the library running east and then south along this curb line to a point near the southeast corner of the curb line. The fire lane shall also run from the origination point south and then east for a distance of 318 feet encompassing both sides of the trafficway (with the exclusion of an area designated by signs for a drop-off zone).[1]

(11) 
Hershey Square Shopping Center. Said fire lane shall consist of the entire east side (rear) of the building, adjacent to the building, absent the loading dock areas of K-Mart and Weis Markets, and the West side (front) of the structure from a point beginning 245 feet six inches south of the northwest corner of Weis Markets, running along the curb line in front of the structure, and ending 347 feet south thereof. Said fire lane is to have a width of 12 feet.
(12) 
Park Village Plaza Shopping Center. Said fire lane shall start at the southeastern corner of the mall and extend to a point 12 feet beyond the northeastern corner, a distance of 596 feet, adjacent to and directly in front of the various places of business in the mall. Said fire lane shall also extend from this point in a westerly direction to a point 174 feet west thereof. The fire lane areas shall extend perpendicular from the concrete curb on the east and the north side of said building for a distance of 12 feet bordering the traffic way.
(13) 
Saint Joan of Arc Church. Said fire lane shall begin at a perpendicular point approximately 30 feet east of Glen Road along the south curbline of Areba Avenue and extend in an easterly direction to a perpendicular point approximately 50 feet east thereof.
(14) 
Factory Stores of Hershey. Said fire lane shall consist of the entire area surrounding all buildings of the factory stores of Hershey, exclusive of the side of all buildings (the sides being the areas which extend from the store fronts to the rear of all buildings). The fire lanes shall extend perpendicular from the building in the rear and concrete curb in the front for a distance of 37 feet out onto the pavement and shall be designated by a combination of posted signs and pavement markings.
(15) 
Hershey Park Stadium.
(a) 
Said fire lane shall begin at the northwest gate and continue south along the west side to the southwest corner extending perpendicular for a distance of 10 feet.
(b) 
Said fire lane shall begin at the southwest corner and extend along the south side to the southeast corner extending perpendicular for a distance of 10 feet.
(c) 
Said fire lane shall begin at the southeast corner and continue along the east side to a point 100 feet north of the northeast gate and extend perpendicular for a distance of 10 feet.
(16) 
Hershey Park Employee Cafeteria. Said fire lane shall begin at the south side entrance door and continue west to a point 40 feet west thereof and a point 20 feet east thereof, extending perpendicular from the building south for a distance of 10 feet.
(17) 
West Areba Avenue. Said fire lane shall begin on the south side of Glen Road to a point 84 feet east.
(18) 
Giant Food Store, 1210 Cocoa Avenue Said fire lane begins at the southwest corner of the building and extends in an easterly direction for approximately 260 feet to the southeast corner of the building and in the rear begins at the northeast and extends 42 feet to the west along the building. The fire lane shall extend perpendicular from the building for a distance of 12 feet into the paved cartway. It is designated by a combination of posted signs and pavement markings.
(19) 
Derry Township Municipal Authority. Said fire lane shall begin at a point 22 1/2 feet east and 73 feet north of the northwest corner of the DTMA office building and extend east for a distance of 65 feet. The fire lane shall extend perpendicular from the edge of the grass/pavement for six feet into the trafficway.
Within a business, residential or urban district, no person shall park an unattended vehicle upon the traveled portion of the roadway in such a manner as to obstruct or interfere with the normal flow of traffic.
It shall be unlawful to park or store boats (loaded or unloaded on trailers) or trailers, defined as a vehicle designed to be towed by a motor vehicle including, but not limited to, recreational vehicles, house trailers and boat trailers, upon any of the streets or highways within the Township of Derry.
Any person who violates any provision of this article shall, upon conviction, be sentenced to pay a fine of not more than $15 and costs.
