A. 
The following article supersedes 25 CFR 11.96ME. Jurisdiction: all Indians.
B. 
Defined. Any entry into the structure of another with unlawful intent. Structures are defined to include, but are not limited to, residences, garages, tribally owned buildings, schools, warehouses, stores, taverns, churches, and any type of outbuildings. Unlawful intent is presumed to be present when a person enters a structure without permission of the owner.

The Court shall have no discretion to substitute for the following penalties:
A. 
First offense: fine of $200 and 30 days in jail and restitution for any damages to or loss of property.
B. 
Second offense: fine of $300 and 60 days in jail and restitution for any damages to or loss of property.
C. 
Third offense: fine of $400 and 90 days in jail and restitution for any damages to or loss of property.
