Whoever knowingly attempts to commit a crime which requires that the actor have an intent to perform acts and attain a result which, if accomplished, would constitute such a crime and that he/she does act toward the commission of the crime which demonstrates unequivocally, under all the circumstances, that he formed that intent and would commit the crime except for the intervention of another person or some extraneous factor may be subject to a penalty as provided in § 290-28..

Whoever is convicted of attempt shall be fined or jailed or both not to exceed 1/2 the maximum penalty for the completed crime.
