It is hereby found and declared that there has been an increase
in the population of the village. The use of the beach and recreational
area owned and maintained by the village has increased greatly. Traffic
control problems have expanded and become more complex. For reasons
of efficiency and more-effective and coordinated care, management,
protection and regulation of the village beach and recreational area,
which benefit and are to the best interests of the village and its
inhabitants, it is hereby found and declared to be necessary and desirable
that the power and duty to care for, manage, protect and regulate
said beach and recreational area should be controlled by the Board
of Trustees.
The Board of Trustees shall have sole responsibility and control
with respect to the care, management, protection and regulation of
the beach and recreational area owned and maintained by this village.
Pursuant to the authority of this Article, the Board of Trustees
further enacts that:
A.
Persons who do not reside in this village shall not use said beach
and recreational area and shall be excluded therefrom unless as guests
of and accompanied by a village resident. The use of the beach by
such guests shall be subject to rules and regulations as established
from time to time by the Board of Trustees.
B.
No motor vehicle shall be admitted to said beach or recreational
area unless a use permit duly issued by the Board of Trustees is displayed
upon the vehicle. Said use permit shall be displayed on and affixed
to the front right bumper and back left bumper of said vehicle. Upon
application by residents of the village, the Board of Trustees is
hereby authorized to issue use permits to them. The Board of Trustees
shall have the power to limit the number of use permits issued to
any family and to establish such fees for said permits as may be deemed
proper by said Board. The Board of Trustees may suspend or revoke
a use permit because of fraud, deceit or misrepresentation in applying
for the permit or for violation of any provision of this section.[1]
C.
No person shall throw, deposit or place or cause to be thrown, deposited
or placed any litter, garbage, trash or refuse on said beach or recreational
area. All such litter, garbage, trash or refuse must be placed in
receptacles provided therefor.
D.
No person shall conduct any concession whatever for the sale of refreshments
or the sale or rental of beach equipment or any other articles or
things whatever.
E.
Every vehicle parked on said beach and recreational area shall be
parked in compliance with such directions as may be given by an officer
or duly authorized agent or employee of the Village of Belle Terre.
G.
No person shall leave the beach and recreational area without having
first completely extinguished any fire started by him.
H.
No person shall use or interfere with any boat, equipment or property
used by or belonging to lifeguards on duty at the beach.
I.
No person shall erect or maintain cabanas or structures of any kind
on the beach and recreational area unless, after written application
has been duly made to the Board of Trustees, which shall comply with
specifications established by such Board, approval, in writing, for
said cabanas or structures has been given by said Board. Such approval
may be on such terms and require payment of such fees as the Board
of Trustees shall determine. Approved cabanas and structures shall
be erected and maintained at the cost and responsibility of the applicant
and shall be erected and maintained only in such area or areas as
may be designated for that purpose by the Board of Trustees.
J.
Every person using said beach and recreational area shall comply
with this section and with any and all other rules and regulations
or resolutions that may be hereafter adopted by the Board of Trustees.
The violation of any provision of this Article shall be punishable
by a fine not exceeding $250 or by imprisonment for not more than
15 days, or both. In addition, the use permit issued to said person
may be revoked or suspended.
