This chapter shall be known as the "Alternate Planning Commission and Zoning Board of Appeals Members Act," and shall apply to the appointment, terms, functions and powers of alternate members appointed to serve on the Planning Commission and Zoning Board of Appeals of the Village of North Syracuse.
It is sometimes difficult to maintain a quorum on the Planning Commission and Zoning Board of Appeals because members are ill, on extended vacation or find they have a conflict of interest on a specific matter before the Commission or Board. In such instances, official business cannot be conducted, which may delay or impede adherence to required timelines. The use of alternate members in such situations is hereby authorized pursuant to the provisions of this chapter.
As used in this chapter, the following terms shall have the meanings indicated:
ALTERNATE MEMBER
Any individual appointed by the Board of Trustees to serve on the Planning Commission or the Zoning Board of Appeals when a member is unable to participate on an application or matter before the Planning Commission or Zoning Board of Appeals, as provided herein.
MEMBER
Any individual appointed by the Board of Trustees to serve on the Planning Commission or the Zoning Board of Appeals.
PLANNING COMMISSION
The Planning Commission of the Village of North Syracuse established by the Board of Trustees of the Village of North Syracuse by Local Law No. 1-1999 pursuant to the provisions of Article 12-A of the General Municipal Law.[1]
ZONING BOARD OF APPEALS
The Zoning Board of Appeals of the Village of North Syracuse established by the Board of Trustees of the Village of North Syracuse pursuant to the provisions of § 7-712 of the Village Law.[2]

A. 
The Village of North Syracuse hereby enacts this chapter to provide a process for appointing alternate members of the Planning Commission and Zoning Board of Appeals. These individuals will serve when members are absent or unable to participate on an application or matter before the respective Commission/Board.
B. 
No more than two alternate members shall be appointed by the Village Board of Trustees to both the Planning Commission and Zoning Board of Appeals. Alternate members to the Planning Commission shall serve for a term of three years, and alternate members to the Zoning Board of Appeals shall serve for five years.
C. 
The Chairperson of the Planning Commission or Zoning Board of Appeals may designate an alternate member to substitute for a Member when such Member is unable to participate on an application or matter before the applicable Commission/Board. Inability to participate shall include, but not be limited to, absence from the meeting or conflict of interest as set forth in Village Code Chapter 19, Ethics, and the New York State General Municipal Law. When so designated, the alternate member shall possess all the powers and responsibilities of such Member of the applicable Commission/Board. Such designation shall be entered into the minutes of the meeting at which the substitution is made.
D. 
All provisions of state law relating to Planning Commission and Zoning Board of Appeals member eligibility, vacancy in office, removal, compatibility of office and service on other boards, as well as any provisions of any local laws or local ordinances relating to training, continuing education, compensation and attendance shall also apply to alternate members.
This chapter is hereby adopted pursuant to the provisions of § 10 of the New York State Municipal Home Rule Law and § 10 of the New York State Statute of Local Governments. It is the intent of the Village of North Syracuse Board of Trustees, pursuant to § 10 of the New York State Municipal Home Rule Law, to supersede the provisions of § 7-712 of the Village Law relating to the appointment of members to Village Zoning Boards of Appeals.
If any provisions of this chapter are held to be unconstitutional or otherwise invalid by any court of competent jurisdiction, the remaining provisions of this chapter shall remain in effect.
This chapter shall take effect upon filing with the Secretary of State.
