This borough shall enter into an agreement (the "agreement") with the Township of Warwick, Lancaster County, Pennsylvania (the "township"), with respect, inter alia, to the provision of mutual aid by the police officers of the municipalities, which agreement is to supplement any existing agreements relating to police mutual aid and statutes providing for statewide municipal police jurisdiction and which agreement sets forth appropriate and necessary covenants and agreements of the respective parties thereto. The agreement shall be substantially in the form presented to this meeting, which agreement and the form thereof are approved.
As required by the Intergovernmental Cooperation Law, 53 P.S. § 481 et seq., the following matters are specifically found and determined:
A. 
The conditions of the agreement are that borough police officers shall have the power and authority of a township police officer when performing police duties in the township, and township police officers shall have the power and authority of a borough police officer when performing police duties in the borough, and each municipality shall retain control over their respective police officers and shall obtain such insurance to protect against liability to the extent deemed appropriate by such municipality.
B. 
The agreement shall continue until modified, in writing, by the mutual consent of both parties thereto or until terminated by a party giving the other 10 days' written notice of the desire to terminate the agreement.
C. 
The purpose and objectives of the agreement are to supplement existing agreements relating to police mutual aid and statutes providing for statewide municipal police jurisdiction.
D. 
There is no financing currently contemplated to implement the agreement.
E. 
No organizational structure is necessary to implement the agreement.
F. 
No property is contemplated to be acquired under the terms of the agreement. Each municipality shall retain ownership of its respective Police Department vehicles and equipment.
G. 
No separate entity will be created under the agreement which will be empowered to enter into contracts for policies of group insurance and employee benefits.
A copy of the agreement, in the form so presented to this meeting and so approved, shall be filed with the Secretary of this borough and shall be made available for inspection at reasonable times by interested persons requesting such inspection.
The Mayor, the President or Vice President of the Council and the Secretary or Assistant Secretary of this borough, as applicable, are authorized and directed to execute, to attest and to deliver the agreement, in behalf of this borough, in the form so approved.
Proper officers of this borough and the Chief of Police are authorized and directed to execute all documents and to do all other acts that may be necessary and proper to carry out this chapter and the undertakings of this borough in the agreement.
