As used in this chapter, the following terms shall have the meanings indicated:
BICYCLE
A device propelled by human power upon which any person may ride and having two tandem wheels, either of which is 20 inches or more in diameter.
No person shall operate a bicycle on streets, lanes or alleys of the borough unless such bicycle has been licensed and a license tag attached thereto as provided herein.
Application for a bicycle license and license tag, entitled "bicycle registration application," shall be made to the Mayor or his delegate, and upon receiving the properly completed application therefor plus a license fee in the amount as provided for in Chapter 55, Fees, the Mayor or his delegate is authorized and directed to issue a bicycle license, which shall be effective for as long as said bicycle belongs to the applicant, except as provided in §§ 34-5C and D and 34-6.

A. 
The Mayor or his delegate shall not issue a license for any bicycle when there are reasonable grounds to believe that the applicant is not the owner or entitled to the possession of said bicycle.
B. 
The Mayor or his delegate shall have the right to inspect any bicycle before licensing same and shall refuse a license for any bicycle which is determined to be in unsafe mechanical condition.
A. 
Upon issuing a bicycle license, the Mayor or his delegate shall also issue a license tag bearing the license number assigned to the bicycle and the name of the borough. Such license tag shall be serially numbered and shall be provided by the borough.
B. 
Such license tag shall at all times be firmly attached to the rear of the bicycle for which issued in such position as to be plainly visible from the rear.
C. 
No person shall remove from a bicycle or alter such license tag except upon a transfer of ownership or in the event the bicycle is dismantled and no longer operated upon any street, lane or alley of this borough.
D. 
In the event a license tag is stolen or lost or becomes illegible, another one shall be issued by the Mayor or his delegate upon payment of a fee as provided for in Chapter 55, Fees.[1]

Upon the sale or other transfer of a licensed bicycle, the licensee shall remove the license tag and shall surrender same to the Mayor or his delegate.
The Mayor or his delegate shall maintain a record of:
A. 
The number of each license, the date issued and the name, date of birth and address of the person to whom issued.
B. 
The number on the frame of the bicycle for which issued.
C. 
A record of all bicycle license fees collected by him.
All fees received by the Mayor or his delegate under the provisions of this chapter shall be paid into the Borough Treasury prior to each regular meeting of the Council.
