This Borough shall join with Elizabeth Township, Warwick Township, Warwick School District and Lititz Community Center (collectively the "participants" and individually a "participant") in accordance with the Pennsylvania Intergovernmental Cooperation Act by entering into the intergovernmental agreement of cooperation (the "intergovernmental agreement"), which is adopted by reference with the same effect as if it had been set out verbatim in this section and a copy of which shall be filed with the minutes of the meeting at which this article was enacted.
This Borough is authorized to enter into and execute the intergovernmental agreement for the purposes contained therein. This action is to be taken by the officials or employees of the Borough designated for this purpose, pursuant to general or specific instructions issued by Borough Council.
As required by the Intergovernmental Cooperation Act, the following matters are specifically found and determined:
A. 
The conditions of the agreement are set forth in the Intergovernmental Agreement referred to in § 10-6.
B. 
The intergovernmental agreement shall become effective as of January 1, 2005, and shall remain in effect for four calendar years until December 31, 2008. Thereafter, the intergovernmental agreement shall be automatically renewed on a yearly basis. Any participant may withdraw at the end of any calendar year, including as of December 31, 2008, by giving written notice of the desire to withdraw to all other participants and to the Warwick Regional Recreation Commission (the "Commission") one year in advance of the date of withdrawal.
C. 
The purpose and objectives of the intergovernmental agreement are to enter into an intergovernmental contract to form the Commission and to share the costs of providing recreational services for the residents of the municipalities.
D. 
Each municipality shall share in the cost of operation of the Commission and its programs on a pro rata basis determined by the population of the municipalities. The municipalities, the school district, and the community center shall also make in-kind contributions by making available without charge the use of real property of each participant and paying costs to maintain their respective properties.
E. 
The Commission shall consist of seven members. Warwick Township shall appoint two members, Lititz Borough shall appoint two members, and Elizabeth Township, the school district, and the community center shall each appoint one member.
F. 
All property, real or personal, shall be managed and disposed of by the owner of such property. The Commission shall have the right to acquire equipment for regional recreation facilities.
G. 
The Commission shall not have the power to enter into contracts for policies of insurance or other employee benefits. Each participant has the power to enter into contracts for policies of insurance and other employee benefits. Subject to the requirements of any grant funding, any director of the Commission shall be an employee of the community center.
The Borough Council reserves the right to modify, supplement or amend the intergovernmental agreement from time to time by resolution or ordinance.
