GENERAL REFERENCES

It shall be illegal for any person to sell or attempt to sell any goods,
merchandise or literature of any kind, or to solicit funds for any purpose
whatever, by door to door canvassing in the Township, unless he or she shall
have first obtained a permit from the Zoning Officer.
A.
Upon application by any person for a permit, the Zoning
Officer shall, within 72 hours, issue a permit if the following conditions
are met:
(1)
A permit fee as set from time to time by resolution of
the Board of Supervisors is paid to the Township of East Allen.
(2)
The applicant provides to the Zoning Officer his or her
name, address, and the names and addresses of at least two references who
can and will personally attest, from their own personal knowledge, to the
good and moral character of the applicant.[1]
(3)
No solicitation shall be allowed on Sundays and only
during daylight hours at all other times.
B.
All permits issued shall be valid for one year from the
date of issue.

Upon application by any person for a permit for the selling of food
or any item that is to be consumed, that person shall show proof of the proper
state health permit or any other permit which shall be required to perform
this activity. Applicant shall also affix his permit or license number on
the application for permit and shall evidence the same with a photocopy of
his permit or license.
The Zoning Officer shall be authorized to issue a permit without charge
when it appears that the proposed solicitation of funds or sales will be for
the benefit of any charitable organization or other similar and worthy nonprofit
cause, i.e., Girl Scouts, Boy Scouts.
Any person who violates or permits a violation of this chapter shall,
upon being found liable therefor in a civil enforcement proceeding commenced
by the Township before a District Justice, pay a fine of not more than $600,
plus all court costs, including reasonable attorney's fees, incurred
by the Township in the enforcement of this chapter. No judgment shall be imposed
until the date of the determination of the violation by the District Justice.
If the defendant neither pays nor timely appeals the judgment, the Township
may enforce the judgment pursuant to the applicable Rules of Civil Procedure.
Each day a violation exists shall constitute a separate offense. Further,
the appropriate officers or agents of the Township are hereby authorized to
seek equitable relief, including injunction, to enforce compliance herewith.
