Nockamixon Township (the "Township"), being a member municipality of the Pennsylvania Municipal Retirement System (the "System"), hereby elects to amend its Municipal Pension Plan administered by the System in accordance with Article IV of the Pennsylvania Municipal Retirement Law, 53 P.S. § 881.101 et seq. ("Retirement Law"), and does hereby agree to be bound by all the requirements and provisions of the Retirement Law and the Municipal Pension Plan Funding Standard and Recovery Act, 53 P.S. § 895.101 et seq., and to assume all obligations, financial and otherwise, placed upon member municipalities.
As part of this article, the Township agrees that the System shall administer and provide the benefits set forth in the amended municipal pension plan contract entered into between the Pennsylvania Municipal Retirement Board and the Township effective April 1, 2013 (the "contract").
The passage and adoption of this article by the Township is an official acceptance of the contract and the financial obligations resulting from the administration of the contract.
Payment for any obligation established by the adoption of this article and the contract shall be made by the Township in accordance with the Retirement Law and the Municipal Pension Plan Funding Standard and Recovery Act. The Township hereby assumes all liability for any unfundedness created due to the benefit structure set forth in the contract.
The Township intends this article to be the complete authorization of the contract, and it shall become effective and specifically repeal Ordinance Number 136, either immediately or on April 1, 2013, which is the effective date of the contract, whichever is later.
A duly certified copy of this article and an executed contract shall be filed with the System.

Nockamixon Township hereby elects to enroll its police officers in the Pennsylvania Municipal Retirement System, as authorized by the Pennsylvania Municipal Retirement Law, Act 15 of 1974, as amended,[1] with the express purpose of having the Pennsylvania Municipal Retirement System administer the retirement plan established by the Township for its police officers. The Township does hereby agree to be bound by all the requirements and provisions of said law and to assume all obligations, financial and otherwise, placed upon member municipalities. All references hereafter shall be based on benefits negotiated between the Board and the municipality under the provisions of Article IV of the Pennsylvania Municipal Retirement Law.

Membership in the Pennsylvania Municipal Retirement System shall be mandatory for all full-time police officers of the Township. Membership for elected officials and employees hired on a temporary or seasonal basis is prohibited, as is membership for individuals paid only on a fee basis.
As part of this article, the Township and the Pennsylvania Municipal Retirement System shall be bound by the terms set forth in the agreement between the Township and the Pennsylvania Municipal Retirement System Board bearing even date herewith. The agreement is attached hereto, marked Exhibit A, and incorporated herein.[1] It is the intention of said agreement to provide police officers enrolled in the Police Pension Plan the benefits set forth in the agreement. The passage and adoption of this article is conditional upon the Pennsylvania. Municipal Retirement Board accepting the terms and provisions of said agreement. The passage and adoption of this article by Nockamixon Township is an official acceptance of said agreement and the financial obligations resulting from the administration of said benefit package. At the time of adoption of this article, the Police Pension Plan is actuarially sound. However, Nockamixon Township hereby assumes all liability for any unfundedness created due to the acceptance of the benefit structure provided in the agreement.

Credit for prior service for original employees is granted for each year or partial year thereof that the member was employed by the Township from the original date of hire. Benefits provided to members in Exhibit A shall accrue based on all credited service granted and earned in accordance with this section. The Nockamixon Township police officer enrolled in the Nockamixon Township Police Pension Plan who has vested benefits shall receive those benefits in accordance with the terms of Exhibit A.
Payment for any obligation established by the adoption of this article and the agreement between the system and Nockamixon Township shall be made by the Township in accordance with the Pennsylvania Municipal Retirement Law and Act 205 of 1984, the Municipal Pension Plan Funding Standard and Recovery Act.[1]

By adoption of this article, the Township agrees to terminate, upon the effective date of membership in the Pennsylvania Municipal Retirement System, any previously maintained municipal pension program applicable to those employees identified as members in § 27-9 of this article as well as any vestees specifically provided for in Exhibit A and to transfer any assets from any existing plan to offset the established liability. Nockamixon Township also acknowledges that an affirmative vote representing at least 75% of the plan members indicated the members were in agreement with the establishment of the plan with the Pennsylvania Municipal Retirement System.
Nockamixon Township intends this article to be the complete authorization of the Township's police pension plan and, therefore, specifically repeals Ordinance No. 55 and all other inconsistent ordinances. It is the intention of the Township, however, that this article and the agreement attached hereto as Exhibit A shall provide a continuation of benefits to Nockamixon Township police officers under Ordinance No. 55.
A duly certified copy of this article and the referenced agreement shall be filed with the Pennsylvania Municipal Retirement System of the Commonwealth of Pennsylvania. Membership for the Police Pension Plan of Nockamixon Township in the Pennsylvania Municipal Retirement System shall be effective the first day of January, 1994.
