Under Section 1141 of the Borough Code, 53 P.S. § 46141, Act of February 1, 1966, P.L. 1656, as amended, there is created the office of Borough Manager. The office shall be filled at the discretion of the Borough Council in consideration of then-current budget and management conditions and policies.

A. 

The Borough Manager shall serve as the chief administrative officer of the Borough and, in such capacity, shall have the following powers and duties of administration of the affairs of the Borough:

(1) 

Attend all meetings, regular and special, of the Borough Council and all meetings of its committees;

(2) 

Supply any and all information pertinent to the agenda for each meeting of the Borough Council, regular or special, and meeting of its committees;

(3) 

Keep the Borough Council informed as to the conduct of Borough affairs, submit periodic reports as the Borough Council needs and/or requests, and make such recommendations to the Borough Council as the Borough Manager deems advisable for the proper administration of the Borough's affairs;

(4) 

Supervise all municipal departments and employees, other than uniformed police officers under the collective bargaining agreement, except where such powers of supervision are conferred by Borough Council by ordinance on another Borough officer;

(5) 

Administer employee operations in accordance with the employee manual/handbook as may be amended from time to time;

(6) 

Make recommendations to the Borough Council for updates, additions, and other modifications to the policies in the employee manual/handbook;

(7) 

With the approval of the Borough Council, hire, suspend and discharge all Borough employees;

(8) 

Recommend to Borough Council wages, salaries and benefits for all Borough employees;

(9) 

With the approval of Borough Council, employ contractors, experts, and consultants to perform work and to advise the Borough Council in connection with a function, program or activity of the Borough;

(10) 

Attend to the letting of contracts and supervise the performance and faithful execution of the same as permitted by law;

(11) 

Take action to see that all money owed the Borough is promptly paid and that proper proceedings are taken for the security and collection of all Borough claims;

(12) 

Serve as the purchasing officer for the Borough and in such capacity issue rules and regulations, subject to the approval of Borough Council, governing the procurement of municipal supplies and equipment; procure, in accordance with the provisions of the Borough Code and any other applicable law, all supplies and equipment for the Borough, its offices, departments and boards; and from time to time or as Borough Council directs, keep an account of all procurement, including making a full written report thereof to Borough Council;

(13) 

Monitor and make application for all grants and loans, subject to the approval or authorization of Borough Council;

(14) 

Hear, investigate, dispose of, and report to Borough Council all complaints regarding Borough services and actions taken to dispose of said complaints;

(15) 

No later than November 1 of each year, prepare and submit to Borough Council for its consideration and action a tentative budget for the next fiscal year;

(16) 

Administer the budget;

(17) 

As soon as possible after the close of each fiscal year, prepare and submit to Borough Council a complete report on the finances and the administrative activities of the Borough for the preceding year;

(18) 

Take action to assure that the provisions of all franchises, leases, permits, approvals and privileges granted by the Borough are observed;

(19) 

Hold other municipal office or offices as the Council may from time to time direct, as may be authorized by law; and

(20) 

Employ such powers and exercise such duties that are customary and ancillary to the foregoing enumerated powers and duties.

B. 

The foregoing powers and duties may be amended from time to time by duly enacted ordinance, subject to recall of the nonlegislative and nonjudicial powers and duties of the Borough Council, the Planning Commission and the Shade Tree Commission. The foregoing powers and duties also may be supplemented from time to time by delegation from the Mayor of his nonlegislative and nonjudicial powers, which delegation shall be subject to approval by Borough Council.

The Borough Council, by majority vote of all of its members, shall appoint the Borough Manager. The initial appointment made under this article shall be made within 30 days of the enactment of this article. Thereafter, appointments or reappointments to the office of Borough Manager shall be made at the first meeting of the Borough Council each year or, in the event the office is vacated during the calendar year, within 30 days of the vacancy. The Borough Manager shall serve at the pleasure of the Borough Council and may be removed at any time by a majority vote of all of its members.

The Borough Manager shall reside within a thirty-mile radius of the Borough of Duncannon within six months following appointment to the office and thereafter for the duration of the appointment.

The Borough Council shall designate one or more qualified members of the Borough personnel to exercise the powers and perform the duties of the office of Borough Manager in the event the Borough Manager becomes ill, is absent or is otherwise unable to serve as the Borough Manager.

The Borough Council shall fix the compensation for the office of Borough Manager from time to time by ordinance.

Upon direction of the Borough Council and at its sole discretion, the Borough Manager, before entering his duties, shall give bond to the Borough Council in a form and amount acceptable to Borough Council, which bond shall be subject to approval by Borough Council and shall be conditioned upon the faithful performance of the duties of the office. The Borough shall pay the premium for the bond.
