As used in this Part 1, the following terms shall have the meanings indicated:
BUSINESS
Any person or persons, corporations, partnerships, or other entities engaged in the buying, selling, storing, transferring, transporting or manufacturing of any item or items for a fee, price or charge, whether or not for gain or profit.
EMERGENCY RESPONSE UNITS
All Township departments and personnel, as well as all independent entities and personnel, authorized to provide emergency services in Warminster Township, including police, fire, rescue, ambulance, and medical services.
INDUSTRIAL ACCIDENT
Any incident that occurs from the storage, transportation, use or manufacture of any substance which is dangerous or potentially dangerous to the public health, safety or welfare for which intervention by Warminster Township or any of its emergency response units or Warminster Township Municipal Authority is deemed necessary or which requires cleanup, abatement, or other action by Township employees or personnel of emergency response units or the Municipal Authority which results in expense to the Township or the Municipal Authority.
PUBLIC THOROUGHFARE
All bridges, state highways, Township streets, or any other roadway or watercourse owned by, dedicated to, or intended to be dedicated to a governmental unit.

The owner, tenant or processor of any property on which a business is conducted shall bear all costs that occur as a direct or consequential result of an industrial accident on the business property. In the event an industrial accident occurs on a public thoroughfare or on private property other than that of a business, the entity which owns or has custody and control of the vehicle or substance involved in the industrial accident shall bear all costs that occur as a direct or consequential result of the industrial accident.

The person or entity which is required to bear all costs that occur as a direct or consequential result of an industrial accident shall pay to Warminster Township or Warminster Township Municipal Authority, upon demand, all reasonable costs incurred by Warminster Township and its emergency response units and Warminster Municipal Authority. All costs shall be itemized and set forth on a statement, which statement shall be provided to the person or entity required to bear the cost.

The costs of an industrial accident shall include, but are not limited to, expenses incurred by police, fire, rescue, ambulance, medical or other emergency response units; direct and indirect labor costs of Township and Municipal Authority personnel; cost of consultants and others to prepare reports concerning industrial accidents; cost of equipment operation; cost of material; cost of any contractual labor and/or materials for cleanup and/or abatement; and cost of the Township and Municipal Authority Solicitor and Engineer.
