There is hereby adopted by the Borough of Towanda, County of Bradford and Commonwealth of Pennsylvania, for the purpose of prescribing rules and regulations for additional toilet facilities, drainage and kindred matters, that certain plumbing code known as the "2006 International Plumbing Code," published by the International Code Council, Inc., and the whole thereof, save and except such portions as are hereinafter deleted, modified or amended, and of which not less than three copies have been and now are filed in the office of the Secretary of the Borough of Towanda, and the same is hereby adopted and incorporated as fully as if set out at length herein, and from and after the date of the passage of this article, the provisions thereof shall be controlling in the Borough of Towanda, and shall be known as the "Towanda Borough Plumbing Code." It is the intent of this article that all future additions and revisions of the 2006 International Plumbing Code shall be deemed to have been adopted by reference by the Council of the Borough of Towanda as soon as the same shall be published.
From and after the effective date of this article, it shall be unlawful, without first securing a permit therefor, to do any plumbing or pipe fitting work which involves the installation of or the roughing-in of openings for one or more water closets, toilets, sinks, wash traps, washtubs, washbasins, leader connections, floor drains, septic tanks or other item or equipment utilizing water or other liquids to carry away waste or sewage, or for any similar purpose.
Upon the filing of a written application in such form as the Building Codes Inspector shall require and upon payment of the required fee, a permit shall be issued in duplicate, one copy thereof to be conspicuously posted upon the premises where the work is being done until the work done has been inspected and approved by the Building Codes Inspector.
A. 
Permit fees.
(1) 
Permits may be granted upon the payment of fees as said fees are established from time to time by resolution of the Council of the Borough of Towanda, Pennsylvania.

(2) 
There will be no permit charge for any work that is routine upkeep and maintenance.
B. 
The plumber in charge of the work shall be responsible for making application, securing the permit and paying the fee or fees herein prescribed.
During the progress of the work or within a reasonable time thereafter, the Building Codes Inspector shall make an inspection to determine whether or not said work complies with the Plumbing Code, the statutes and ordinances governing the same. If he shall find that said work does not so comply, he shall notify and require the owner of the premises and the plumber to remedy the same within three days after receipt of such notice, and it shall thereupon be the duty both of such owner and of such plumber to comply with such notice. Failure to comply will constitute a violation punishable as herein set forth.
This article shall apply to all structures, installations and equipment in which any sanitary or waste facilities are an integral part thereof, including but not limited to residential, commercial and industrial buildings and house trailers, office trailers or mobile homes. All owners and general contractors shall be required to provide temporary sanitary toilet facilities on any and all building construction work, if permanent facilities are not available.
All references in the International Plumbing Code to "master plumber" shall be interpreted as a reference to any qualified plumber or the owner of the property involved.

It shall be unlawful for any person, firm or corporation to violate any provision of this article or to cause, permit or suffer any such violation to be committed. Any such person, firm or corporation shall be deemed guilty of a summary offense and, upon conviction thereof, shall be sentenced to pay a minimum fine of $25 or a maximum fine of $1,000, or by imprisonment for a period not exceeding 30 days. Provided: Each day's continuance of a violation shall constitute a separate offense.

Each section of this International Plumbing Code and every part thereof is hereby declared to be an independent section or part of a section, and if any section, subsection, sentence, clause or phrase of this International Plumbing Code shall, for any reason, be held by any court to be invalid, it is the intent that the validity of the remaining phrases, clauses, sentences, subsections and sections of the International Plumbing Code shall not be affected thereby.
