Pursuant to N.J.A.C. 5:23(c), the New Jersey Department of Community
Affairs ("DCA") shall administer and enforce the Uniform Construction
Code and the regulations promulgated thereunder, including but not
limited to all subcodes, and shall serve as the exclusive enforcing
agency with respect to the Uniform Construction Code, all subcodes
and all areas of the regulations within the limits of the Township
of Allamuchy.

Whenever a change of occupancy occurs at a one- or two-family
dwelling within the Township of Allamuchy, the Department of Community
Affairs shall verify that at least one smoke detector is present and
in working order on each level of said dwelling. Such Department shall
provide the applicant, upon request and payment of the required fee,
with a certification that smoke detectors are present as required
and are in working order. Compliance with this section may also be
accomplished by providing the Department of Community Affairs with
a certification from a licensed real estate agent, attorney, engineer,
fire protection subcode inspector, employee of a licensed title company
or certified fire official/fire inspector that such smoke detectors
are present and in working order on each level of the subject dwelling.

For the services rendered by the Construction Enforcement Agency
and for the time after the DCA shall assume the responsibilities for
the enforcement of the Uniform Construction Code, the fees promulgated
by the New Jersey Department of Community Affairs for the administration
and enforcement of the Uniform Construction Code shall be as set forth
in the DCA's published schedule of fees, as that schedule may
be amended from time to time.

No person shall be charged a construction permit surcharge fee
or enforcing agency fee for any construction, reconstruction, alteration
or improvement designed and undertaken solely to promote accessibility
by disabled persons to an existing public or private structure or
any of the facilities contained therein.
