There are hereby adopted administrative regulations known as the "Standards for Individual Subsurface Sewage Disposal Systems" promulgated pursuant to laws of the State of New Jersey at N.J.A.C. 7:9A-199 as and for the construction, operation and continuance of individual sewage disposal systems in and for the Township of Allamuchy, a copy of said code being placed on file with the Township Clerk of the Township of Allamuchy, which text of said code is made a part of this chapter without the inclusion of the text herein. Said code may from time to time be amended, which amendments shall form a part of the Code of the Township of Allamuchy as if originally adopted by the Mayor and Council of the Township of Allamuchy.
Said code established and adopted by this chapter pursuant to § 238-1 is hereby described and commonly known as the "Standards for Individual Subsurface Sewage Disposal System Code of the State of New Jersey (1990)."
Pursuant to N.J.S.A. 26:3-69.2, the Code for Individual Subsurface Sewage Disposal System, known as N.J.A.C. 7:9A-199, as may be adopted and modified from time to time, is hereby adopted, and three copies of said code have been placed on file in the office of the Township Clerk of the Township of Allamuchy and will remain on file in said office for the use, examination, copying and reference of the public.
A. 
No person shall locate, construct or alter any individual sewage disposal system until a permit for the location, construction or alteration of said sewage disposal system shall have been issued by the Township Council and/or any individual acting as an agent of the Township of Allamuchy.
B. 
The Township Council and/or any individual acting as an agent of the Township of Allamuchy shall issue a permit if the application so made to the Township Council and/or any individual acting as an agent of the Township of Allamuchy is strictly in conformance with the Code for Standards for Individual Subsurface Sewage Disposal Systems. No permit shall be issued unless there is full compliance with said code.

A. 
New individual disposal systems shall not be placed in operation, nor shall new dwellings or buildings or additions thereto which must rely on such a system for sewage disposal be sold or occupied, until the Township Council and/or any individual acting as an agent of the Township of Allamuchy shall have issued a certificate indicating that said disposal system has been located and constructed in compliance with the terms of the permit issued and the requirements of the aforesaid code. Issuance of such certificate shall not be required for alterations to an existing individual sewage disposal system.
B. 
The Township Council and/or any individual acting as an agent of the Township of Allamuchy may issue such a certificate if an engineer licensed to practice professional engineering in New Jersey submits a statement in writing, signed by him, to the Township Council and/or any individual acting as an agent of the Township of Allamuchy that said disposal system has been located and constructed in accordance with the terms of the permit issued and the requirements of the aforesaid code.

In case any permit or certification required by this chapter is denied by the Township Council and/or any individual acting as an agent of the Township of Allamuchy, a hearing shall be held thereon before the Council within 15 days after request therefor is made by the applicant, and upon such hearing the Township Council and/or any individual acting as an agent of the Township of Allamuchy shall affirm, alter or rescind its previous determination and shall take action accordingly within 15 days after the date of such hearing.

There is hereby adopted by reference the schedule of fees for all permits required in accordance with this chapter by the Board of Health of the County of Warren as and for the fees and charges to be paid in connection with the administration of the provisions of this chapter. Three copies of said schedule of fees promulgated by the Board of Health of the County of Warren shall be placed on file with the Township Clerk and shall be available for the use of, examination of and copying by the public.
It is the intention of the Mayor and Council of the Township of Allamuchy to adopt the code as set forth in this chapter known as the "Standards for Individual Subsurface Sewage Disposal Systems" as contained in Chapter 9A of Title 7 of the Administrative Code of the State of New Jersey (Section 199). Any law, rule or ordinance inconsistent with said code is hereby deemed null and void, and said code shall prevail unless a more stringent rule, regulation or ordinance shall have been promulgated and approved pursuant to the provisions of Chapter 9A of Title 7 of the Administrative Code of the State of New Jersey.
A. 
Any person or persons, firm or corporation violating any of the provisions of or any order promulgated under this chapter or the Standards for Individual Subsurface Sewage Disposal Systems Code of New Jersey (1990) made a part hereof shall, upon conviction thereof, be liable to the general penalty in Chapter 1, Article II, General Penalty, of the Township Code, including a fine of not less than $50 for each violation.[1]

B. 
Each day a particular violation continues shall constitute a separate offense.
