A. 
The office of Purchasing Agent is hereby created. Such person shall be assigned the authority, responsibility, and accountability for the purchasing activities of the Borough, under the supervision and direction of the Borough Administrator, except as otherwise set forth below. The Purchasing Agent duties include but are not limited to the following:
(1) 
Awarding of contracts, which total aggregate sum does not exceed the bid threshold as set forth pursuant to N.J.S.A. 40A:11-3, after receiving quotations pursuant to New Jersey law.
(2) 
Preparing public advertising for bids and receiving bids, all in accordance with Title 40A of the New Jersey Statutes.
(3) 
Administering the competitive contracting processes in accordance with N.J.S.A. 40A:11-4.4, 40A:11-4.5 and 40A:11-9, including preparation of requests for proposal documentation, i.e., all requirements deemed appropriate and necessary to allow for full and free competition between vendors; information necessary for potential vendors to submit proposals; and a methodology by which the Borough will evaluate and rank proposals received from vendors.
(4) 
Administering purchases which constitute emergencies pursuant to N.J.S.A. 40A:11-6 and the regulations promulgated thereunder.
(5) 
Fulfilling such other duties relating to purchasing as may be assigned by the Mayor and Council or the Administrator or as provided in accordance with Title 40A.
B. 
Processing of "fair and open" requests for qualifications for professionals and/or requests for proposals shall be the responsibility of the Borough Administrator who may delegate such duties to the Purchasing Agent.
The Purchasing Agent shall be appointed by the Mayor with the advice and consent of the Borough Council for a term of one year beginning January 1 of each year, except the initial Purchasing Agent shall serve from the date of appointment until December 31 or until the person's successor is appointed, whichever occurs later. Such person may be a full-time or part-time employee of the Borough. In addition, the person must be a citizen of the United States, of good moral character, a high school graduate or equivalent, and have two years of higher education or two years of governmental experience. In the event the New Jersey Legislature promulgates laws governing the activities and appointment of Purchasing Agents, the Borough Purchasing Agent shall take whatever courses and exams which may be required pursuant to such laws.
