The Town Board of the Town of Greenville, County of Orange, State of New York, believes that the health, welfare and public safety of the citizens of the Town of Greenville, County of Orange, State of New York, will be served by a local law prohibiting the running at large of domestic animals in public places and upon private property.
As used in this article, the following terms shall have the meanings indicated:
DOMESTIC ANIMAL
Any domesticated sheep, horse, cattle, goat, swine, fowl, duck, goose, swan and/or turkey.
HARBOR
Any person who provides food, water and shelter for any domestic animal defined in this article.
NONRESIDENT
Any person who does not reside in the Town of Greenville, County of Orange, State of New York.
OWNER
Any person who harbors or keeps any domestic animals as defined in this article.
PERSON
Any individual, corporations, partnership, association or other organized group of persons and/or other legal entity.
PRIVATE PROPERTY
Any real property, posted or unposted.
PUBLIC PLACE
All highways, sidewalks, waterways, including ditches, and all public property, including public park grounds, or other such public places as defined by § 240.00 of the New York State Penal Law.
TOWN BOARD
The Town Board of the Town of Greenville, County of Orange, State of New York.
A. 
No person shall permit any domestic animal to run at large in any public place as defined in this article.
B. 
No person shall permit any domestic animal, as defined in this article, to run at large upon real property without the permission of the owner, lessee or lawful occupant.
Any person owning, leasing or renting real property in the Town of Greenville, County of Orange, State of New York, for the purpose of boarding and/or raising of domestic animal(s), as defined in this article, who is not residing on said property, must reside within one-half-hour normal driving distance from said property.
Any domestic animal, as defined in this article, which cannot be seized and/or confined in a humane manner and which is causing a safety hazard to human life shall be humanely dispatched by any peace officer, police officer and/or by any person after a good faith effort to consult with the local Animal Control Officer under the circumstances. No liability in damages or otherwise shall be incurred on account of such destruction.
A. 
Any domestic animal, as defined in this article, having been humanely seized, shall be transported and confined to a facility where sufficient supply of good and wholesome air, food, shelter and water will be provided. The owner or person responsible for any domestic animal, as defined in this article, will be liable for all expenses incurred in the seizure of said animals and while said animal or animals were confined.
B. 
If any domestic animal, as defined in this article, while being confined, becomes sick and/or dies, the facility where the domestic animal is (was) confined will not be liable in damages nor otherwise incurred on account of such sickness or death.
Any domestic animal, as defined in this article, which enters upon any public or private property and destroys or damages any bars, gates and/or fence, or any part thereof, or defaces or damages any vehicle, buildings, lawn, shrub, tree, plant, ornamental fixture or appurtenances to the land, it will be the owner or person harboring the domestic animal, as defined in this article, who shall pay for all damages incurred.
Any person, firm or corporation who or which shall violate any of the provisions of this article or any rule or regulation made pursuant thereto shall, upon conviction thereof, be subject to a fine of not more than $250 or to imprisonment for not more than 15 days, or both such fine and imprisonment.
A. 
The existing Animals Law for the Town of Greenville shall be repealed.
B. 
This law shall replace the existing Animals Law.
