[Adopted 4-26-1965 (Ch. 28, Art. I, of the 1974 Township Code); amended in its entirety at time of adoption of Code (see Ch. 1, General Provisions, Art. I)]
No person shall sell or distribute alcoholic beverages in the Township otherwise than as provided in this article and N.J.S.A. 33:1-1 et seq. and the rules and regulations promulgated by the State Commissioner of Alcoholic Beverages.
A. 
All premises licensed under this article shall, subject to any state laws or regulations that may supersede local ordinance, be closed on weekdays between the hours of 2:00 a.m. and 6:00 a.m., prevailing time, and on Sundays between the hours of 2:00 a.m. and 12:00 noon, prevailing time, for on-site consumption of alcoholic beverages and between the hours of 2:00 a.m. and 11:00 a.m., prevailing time, for the sale of packaged goods, except that, on the first day of January in each year, the activities aforesaid may be continued until 4:00 a.m., prevailing time.
B. 
During the hours when the sale, consumption or distribution of alcoholic beverages is prohibited, no person shall be admitted or permitted to remain on the licensed premises except the licensee, members of his family, bona fide employees, including any person temporarily employed for necessary construction, alteration or repairs, and officers of the law duly authorized to enforce Township, state or federal regulations regarding the sale of alcoholic beverages or to make investigations relative thereto.
The Township Clerk may issue a special permit, which will have the effect of suspending the prohibitions of § 139-1, where an application shall be received by the Township Clerk for the holding of a public or quasi-public, charitable, fraternal or social event and where the Chief of Police shall determine:
A. 
The holder of the event will not be in violation of any regulation, rule or provision of the Alcoholic Beverage Laws of the State of New Jersey or of the Township of Eastampton.
B. 
Adequate police protection can be afforded to prevent the creation of a riotous or disorderly assembly, with the provisions of such protection being established clearly within the application addressed to the Township Clerk.
C. 
Adequate provisions have been made to ensure that trash and debris emanating from the gathering will be quickly disposed of by the organizers of the event and will not create a burden upon the facilities of the Township to cause such trash and debris to be removed.
Any person violating or failing to comply with any of the provisions of this article shall, upon conviction thereof, be subject to the penalty set forth in Chapter 1, Article II, Penalties for Violations, of the Township Code.
