The duty of administering and enforcing the provisions of this chapter is hereby conferred upon a Zoning Officer and the Building Inspector, who shall have such powers as are conferred upon them by this chapter, and as reasonably may be implied. A Zoning Officer shall be appointed by the Township Manager and shall receive such compensation as the Township Council shall determine. In no case shall a permit be granted for the construction of or alteration of any building where the proposed construction, alteration or use thereof would be in violation of any provision of this chapter. It shall be the duty of the Zoning Officer or the Building Inspector, or their duly authorized assistants, to cause any building, plans or premises to be inspected or examined and to order in writing the remedying of any conditions found to exist in violation of this chapter, and the Zoning Officer or Building Inspector shall have the right to enter any building or premises during the daytime in the course of duties.
A. 
Zoning permits. Zoning permits shall hereafter be secured from the Zoning Officer or the Building Inspector prior to the issuance of a building permit for the construction, erection, or alteration of any structure or part of a structure or upon a change in the use of land or a structure.
B. 
Special use permits. Application for any special use permit as provided in this chapter shall be made to the Zoning Board of Adjustment through the Zoning Officer or the Building Inspector. The following procedures shall apply:
(1) 
The Secretary of the Board of Adjustment shall refer the matter to the Secretary of the Planning Board within one week after the receipt of such plans for the purpose of obtaining a report thereon as to the effect of the same upon the planning and development of the Township.
(2) 
In approving any such application for a special use permit, the Zoning Board of Adjustment may impose any conditions it deems necessary to accomplish the reasonable applications of applicable standards as provided in §§ 370-78 through 370-88 and may deny any such application, but only in accordance with such standards.
(3) 
In the event that the decision of the Zoning Board of Adjustment does not correspond with the recommendation of the Planning Board, the question shall be resolved by the Township Council, in accordance with the procedure outlined in N.J.S.A. 40:55-1.13.[1]

(4) 
The fee for a special use permit shall be as provided in § 150-5D of the Code of the Township of Willingboro.
C. 
Temporary use permits. Recognizing that it may be in accordance with the purpose of this chapter to permit temporary activities for a limited period of time, which activities may not be permitted by other provisions of this chapter, the Zoning Board of Adjustment is hereby empowered to grant temporary use permits, under the same regulations and procedures for the issuance of special use permits as specified elsewhere in this chapter. The Board shall determine that such uses are of such a nature and are so located that, at the time of petition, they will in no way exert a detrimental effect upon the uses of land and the activities normally permitted in the zone or contribute materially to the general welfare of the Township of Willingboro, particularly in a state of emergency, under conditions peculiar to the time and place involved. Under such determination, the Board of Adjustment shall direct the Building Inspector to issue a building permit for a period not to exceed six months; such period may be extended not more than once for an additional period of six months.
D. 
Certificate of occupancy. Certificates of occupancy shall be issued by the Zoning Officer or the Building Inspector. On the serving of notice by the Zoning Officer, Building Inspector or Township Manager, to the owner, of any violation of any of the provisions or requirements with respect to any building or use thereof or of land, as specified in this chapter, the certificate of occupancy for such use shall be deemed to be in violation of this chapter and subject to the penalties hereinafter prescribed. A new certificate of occupancy shall be required for any new or revised use of such land or building or for any other use requiring substantial modification of the building, except where the same takes place in either a major shopping center or a planned shopping center. No fee shall be charged for an original certificate of occupancy as required herein, but, for each copy of an original certificate, there shall be a charge as provided in § 150-7 of the Code of the Township of Willingboro, which shall be remitted to the Township Treasurer by the issuing officer in accordance with the manner of reporting and payment as is generally provided.
E. 
Records. It shall be the duty of the Zoning Officer or the Building Inspector to keep a record of all applications for zoning permits, a record of all permits issued, and a record of all certificates of occupancy which are countersigned, together with a notation of all special conditions involved. The Zoning Officer and Building Inspector shall file and safely keep copies of all plans submitted, and the same shall form a part of the records of the office of the Zoning Officer and Building Inspector and shall be available for the use of the officials of the Township of Willingboro. The Zoning Officer or the Building Inspector shall prepare a monthly report for the Township Manager summarizing for the period since the last report all zoning permits issued and certificates countersigned by the Zoning Officer or Building Inspector and all complaints of violations and the action taken by the Zoning Officer or Building Inspector consequent thereon.
F. 
Flatwork permits.

(1) 
Applications for any concrete-flatwork shall be made to the Zoning Officer and approved prior to the issuance of a zoning flatwork permit. The following work activities are defined as flatwork:
(a) 
Patios/porches.
(b) 
Stoops.
(c) 
Concrete pads.
(d) 
Concrete driveway.
(e) 
Service walk/sidewalks (private property).
(2) 
The fee for a flatwork permit shall be as provided in § 150-7 of the Code of the Township of Willingboro.
