The subdivider shall submit to the Borough Secretary-Treasurer eight copies of a preliminary plan meeting the requirements of Article
V, Plan Requirements, §
241-25, not less than 15 days prior to the regular meeting of the Planning Commission.

A. The Borough Secretary-Treasurer shall immediately send one copy of
the plan to the Borough Planning Commission, five copies to the County
Planning Commission, one copy to the Pennsylvania Department of Transportation
District Office, if the subdivision will enter any existing or proposed
state highway, and one copy to the Borough Engineer.
B. The County Planning Commission will review and retain one copy for
its records. Four reviewed and stamped copies will be returned to
the Borough Planning Commission.
C. The Borough Planning Commission will approve as submitted or conditionally approve, or disapprove, and retain one copy for Borough records. Three copies reflecting the Borough Planning Commission action will be returned to the applicant for the purpose of preparing the final plan per §
241-9.
The Planning Commission shall review at its regular meeting
the subdivision and any reports received from the County Planning
Commission, State Highway Department, and Borough Engineer. Within
90 days after the submission of the plan, unless the subdivider withdraws
his preliminary plan, the Planning Commission shall decide whether
to conditionally approve the plan as submitted or modified or to disapprove
the plan. The Planning Commission shall notify the subdivider in writing
not later than five days after the meeting, and Borough Council of
its action. The plan shall be considered as approved if there is not
action by the Planning Commission within the ninety-day period. Any
modification of the preliminary plan required as prerequisite to approval
shall be noted on the copies retained by Council and the Planning
Commission.
Approval of the preliminary plan shall constitute conditional
approval of the subdivision as to the character and intensity of development,
general layout, and approximate dimensions of streets and lots. The
approval binds the subdivider to the general scheme of the subdivision
shown; permits the subdivider to proceed with the installation of
site improvements, subject to obtaining necessary work permits from
the Borough; and permits preparation of the final plan. Approval of
the preliminary plan does not authorize the sale of lots nor the recording
of the preliminary plan.
