The regulations set forth in this article for each district
shall be minimum regulations and shall apply uniformly to each class
or kind of structure or land, except as may be hereinafter provided.
A. No building, structure or land shall hereafter be used or occupied
and no building or structure or part thereof shall hereafter be erected,
constructed, reconstructed, moved, or structurally altered except
in conformity with all of the regulations herein specified for the
district in which it is located.
B. No building or other structure shall hereafter be erected or altered
to: exceed the height or bulk; accommodate or house a greater number
of persons or families; occupy a greater percentage of lot area; or
to have narrower or smaller rear yards, front yards, side yards or
other open space; than is required in this article, or in any other
manner be contrary to this chapter.
C. No yard or lot existing at the time of adoption of this chapter shall
be reduced in dimension or area below the minimum requirements herein
specified for the district in which it is located.
D. The commencement of any of the uses or activities listed in this article shall require the issuance of a zoning permit from the Borough Zoning Officer, except as may be exempted by §
286-94A of this chapter.
Note: All uses and development in this district shall be undertaken in compliance with the historic preservation standards and criteria set forth in Article
VII of this chapter and any subsequently enacted historic preservation regulations.

(2) Permitted accessory uses and structures (Zoning Officer): same as
underlying district.
(3) Special exception uses and structures (Zoning Hearing Board): same
as underlying district.
(4) Conditional uses and structures (Borough Council): same as underlying
district.
B. Lot, yard, and open space requirements.
(1) Minimum lot requirements (see §
286-50): same as the underlying district.
(2) Minimum yard requirements (see §
286-51): same as the underlying district.
(3) Maximum height requirements (see §
286-52): same as the underlying district.
Note: All uses, activity, and/or development in this district shall be undertaken in strict compliance with the floodproofing requirements set forth in Article
VI of this chapter and any subsequently enacted floodplain management regulations.

Note: No development shall be permitted in this district which will increase the elevation of the one-hundred-year flood. (See also Article

Land cultivation, including plant nurseries and/or landscaping
businesses.
(b)
Public or private park or playgrounds.
(c)
Temporary uses, such as carnivals or circuses.

the underlying district, and in addition:
(a)
Accessory residential uses; i.e., yards, gardens, etc.
(b)
Accessory commercial or industrial uses; i.e., pervious parking
areas, etc.
(3) Special exception uses and structures (Zoning Hearing Board). Same
as the underlying district, and in addition:
(a)
Public utility buildings, structures, facilities and installations.
(4) Conditional uses and structures (Borough Council). Same as the underlying
district, and in addition:
(a)
Water-related uses; i.e. docks, piers, marinas, etc.
