The restrictions on stopping and parking vehicles found in §§ 346.50
through 346.56, Wis. Stats., and all amendments thereto, now and/or
in the future, are hereby adopted by reference and made a part of
this section with the same effect as if fully set forth herein. For
the purpose of this section, the definitions of words and phrases
contained in Ch. 346, Wis. Stats., are hereby adopted by reference
with the same effect as if fully set forth herein. In addition, any
area marked temporarily by the Town representative authorized to do
so with no-parking or tow-away signs shall be included in the areas
where parking is prohibited as described in the above-adopted references.
The Town may establish that no owner or operator of any vehicle
or device upon which any person or property is or may be transported
or drawn upon any public highway shall park, stop or leave standing
any such vehicle or device at the curb, shoulder, roadway or fire
lane in the Town upon which or upon a portion of which a "no parking"
sign has been erected designating the limits or area within which
there is to be no parking.
No owner or operator of any vehicle or device upon which any
person or property is or may be transported or drawn shall park, stop
or leave standing any such vehicle or device at the curb, shoulder,
or edge of the following streets located in the Town:
A. On the east side of Sleepy Hollow Road from the stop sign located
at the southeast corner of the Sleepy Hollow Road and Lighthouse Lane
intersection southeasterly on Sleepy Hollow Road for a distance of
44 feet.
B. On the west side of Sleepy Hollow Road from the southwest corner
of the Sleepy Hollow Road and Lighthouse Lane intersection southeasterly
for the distance of 300 feet.
C. On the south side of Lighthouse Lane from the northeast corner of
the Lighthouse Lane and Sleepy Hollow Road intersection easterly for
a distance of 50 feet.
Any vehicle parked, stopped or standing upon a highway in violation
of any of the provisions of this article is declared to be a hazard
to traffic and public safety. Such vehicle shall be removed by the
operator in charge to a position where parking is permitted or to
a private or public parking or storage premises or property. Any officer,
after issuing a citation for either illegal parking, stopping or standing
of any unattended vehicle in violation of this article, is authorized
to remove such vehicle to a position where parking is permitted or
to cause the towing of such vehicle. In addition to other penalties
provided by this article, the owner or operator of a vehicle so removed
shall pay the reasonable costs of removing, towing and storage. If
the vehicle is moved or towed by a private motor carrier, the motor
vehicle tower is entitled to recover the actual charges regularly
paid for such service. If the vehicle is stored in a public storage
garage or rental facility, customary charges for such storage shall
be paid. Upon payment, a receipt shall be issued to the owner of the
vehicle for the towing or storage charges.
In addition to removal of illegally parked vehicles under §
480-18 above, the Town of Barton may impose a forfeiture on any person violating §§ 346.503 to 346.55, Wis. Stats., in an amount as prescribed in § 346.56, Wis. Stats. Violations of §§
480-15,
480-16 and
480-17 of this article shall be subject to a forfeiture as prescribed in § 346.56(1m), Wis. Stats.
The procedures and trial of a forfeiture action for the nonmoving
traffic violation for which this article applies are governed by §§ 345.28
and 345.34 to 345.47, Wis. Stats. Where no specific procedure is provided
in §§ 345.28 or 345.34 to 345.47, Wis. Stats., Ch.
799, Wis. Stats., applies to actions in Circuit Court.
This article shall, in accordance with § 60.80, Wis.
Stats., take effect the day after its publication as a Class 1 notice
under Ch. 985, Wis. Stats., and the installation of no-parking signs
as may otherwise be required.
