No person shall discharge septage into the POTW's treatment
plant without a license from the Director. Applicants for said licenses
shall apply on a form provided by the Director. These forms may require
information such as vehicle specifications, vehicle license number,
vehicle color, DEC permits issued under 6 NYCRR Part 364, approximate
annual septage volume expected, service area, lists of residences
from which the applicant expects to pick up septage and any other
information that the Director may require to determine whether the
septage could adversely impact the POTW. The application shall be
accompanied by a fee prescribed by the Director, not to exceed $250.
If a license is issued, the licensee may then purchase from the Director
tickets to discharge septage into a designated place at the POTW.
Provided that the licensee complies with all requirements of this
article, each ticket shall permit the licensee to discharge 1,000
gallons of septage into the POTW at a cost not to exceed $100 per
ticket.
The applicant for a septage license shall be the owner of the
vehicle or vehicles to be used for septage discharges. Any false or
misleading statement in any license application shall be grounds for
invalidating the license. All licenses issued by the Director shall
be for one year's duration. The licensee shall also be duly permitted
by the DEC under 6 NYCRR Part 364. If, for any reason, the DEC permit
issued under 6 NYCRR Part 364 is revoked, lapses or becomes invalid,
then the license issued under this article shall become invalid immediately.
Said license may be suspended or revoked at any time by the Director
for violation of its terms or of the requirements of this chapter
or the Act.
No person shall discharge into the POTW's treatment plant
septage containing any substance other than sanitary sewage from a
residence located within the Town of Orangetown. Before discharging
a load of septage into the treatment plant, the septage hauler shall
provide the POTW with a list of residences from which the hauler picked
up septage for that load, a statement of the volume and nature of
the septage, a certification from an owner or occupant of each residence
as to the volume of septage and the date the septage hauler picked
up its load from that residence and any other information requested
by the Director. The Director has the discretion to refuse to accept
any septage load based on the type, concentration or quantity of pollutants
or on the capability or capacity of the POTW to treat the septage.
All septage discharges must comply with all pretreatment standards
and pretreatment requirements and may not contain hazardous wastes.
The Director shall restrict septage discharges to certain designated
locations at the POTW. The Director also may restrict septage discharges
to certain times, to certain days of the week or to certain seasons
of the year.
Each discharge of septage shall be made only with the approval of the Director. The Director may require inspection, sampling and analysis of each load of septage prior to the discharge of the load. Any costs associated with such inspection, sampling and analysis shall be paid by the licensee and shall be in addition to the dumping fee set forth in §
30A-30 of this chapter.
