The following definitions shall apply in the interpretation and enforcement of this chapter:
(a) 
Minibike: a motorized vehicle with two, three, four or more wheels propelled by one or more motors. This definition shall include, but not be limited to, motorized scooters, go-carts, gas buggies, snowmobiles, land cats, land rovers and dune buggies, provided, however, the definition shall not include motorized bicycles and motorcycles.
(b) 
Motorized bicycle: a motorized vehicle as defined in R.S. 39:1-1.
(c) 
Motorcycle: a motorized vehicle as defined in R.S. 39:1-1.
(d) 
Public place: any area, including streets, roadways and pedestrian walkways and any public recreation areas located in the Borough.

(a) 
It shall be unlawful for any person to operate a minibike, motorized bicycle or motorcycle in or upon any public place, provided, however, that motorized bicycles, motorcycles or any duly registered motor vehicle may be operated in or upon public streets, roads or highways in accordance with the provisions of R.S. 39:1-1, et seq.
(b) 
It shall be unlawful for any person to permit, suffer or allow the operation of a minibike, motorized bicycle or motor-cycle in or upon any public place, provided, however, motorized bicycles, motorcycles or any duly registered motor vehicle may be operated in or upon any public street, road or highway in accordance with the provisions of R.S. 39:1-1, et seq.

It shall be unlawful for any person to operate a minibike, motorized bicycle or motorcycle in or upon any private property within the Borough of Morris Plains without express written permission to do so by the owner or occupant of said property; provided, however, that such written permission must be in possession of the operator of the minibike, motorized bicycle or motorcycle when operating such vehicle on such private property.

Any person who shall violate any of the provisions of this chapter shall, upon conviction thereof, be punished by a fine not exceeding $200. Any vehicle used in violation of this chapter shall be confiscated and removed to the police department garage. Such confiscated vehicle may be released to the owner upon the owner's payment of towing and storage costs.
